2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly:

4 | | Section 5. The Counties Code is amended by changing |
5 | | Section 3-8017 as follows:
|
6 | | (55 ILCS 5/3-8017) (from Ch. 34, par. 3-8017)

7 | | Sec. 3-8017. Enforcement of orders. If any provision of |
8 | | this
Division or any order of the
the Merit Commission is |
9 | | violated by any person,
regardless of whether that person's |
10 | | employment is under the jurisdiction of
the Division, the |
11 | | Commission may apply to the circuit court for relief by
|
12 | | injunction, mandamus or any other proper relief. The State's |
13 | | Attorney of
the county where the violation occurred shall |
14 | | prosecute such action.
Whenever the State's Attorney for the |
15 | | county where a violation is alleged
to have occurred refuses |
16 | | to prosecute the action, or fails to begin to
prosecute such |
17 | | action within 30 days after the date the Commission brings
the |
18 | | matter to his attention, the Commission may retain special |
19 | | counsel of
its own choice to prosecute such action. |
