Amends the Local Government Officer Compensation Act. Provides that a compensation-setting ordinance or resolution shall include all forms of included compensation, including salary, benefits, stipends, insurance, vehicle allowance, cell phone, equipment, internet, discounts, free additional materials, services, or any other fringe benefit, technology, material, service, the official will be eligible to receive once taking office. Provides that, if a unit of local government fails to comply with the provisions, then any person residing within the unit of local government, or the State's Attorney of the county in which such noncompliance may occur, may bring a civil action in the circuit court for the judicial circuit in which the alleged noncompliance has occurred or in which the affected public body has its principal office to force compliance with the provisions. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Local Government Officer Compensation Act |
5 | | is amended by changing Section 2 as follows:
|
6 | | (50 ILCS 145/2)
|
7 | | Sec. 2. Time and manner of fixing compensation. |
8 | | (a) Notwithstanding any other law to
the contrary, the |
9 | | compensation of elected officers of school districts and
units |
10 | | of local government, including home rule units, which |
11 | | compensation is to
be fixed by that school district or unit of |
12 | | local government, shall be fixed at
least 180 days before the |
13 | | beginning of the terms of the officers whose
compensation is |
14 | | to be fixed. |
15 | | (b) In addition to the requirements of subsection (a), the |
16 | | compensation of county elected officers shall be fixed by |
17 | | ordinance or resolution of the county board or the board of |
18 | | county commissioners. In the ordinance or resolution fixing |
19 | | the compensation of county elected officers under subsection |
20 | | (a), the county board shall separately list each stipend an |
21 | | elected officer is expected to receive in addition to the |
22 | | compensation to be paid by the county. The stipends listed |
23 | | shall include, but are not limited to, stipends expected to be |
