5 | | Sections 1-3, 10-20.13, 27A-5, 28-19.2, and 34-21.6 as |

9 | | The terms "common schools", "free schools" and "public |

operating under authority of this Code, including |
14 | | board of school directors
and board of education. When the |
15 | | context so indicates it also means the

2 | | "School fees" or "fees" means any monetary charge |
3 | | collected by a public school, public school district, or |

6 | | any curricular or extracurricular program of the school or |
7 | | school district as defined under paragraphs (1) and (2) of |
8 | | subsection (a) of Section 1.245 of Title 23 of the Illinois |
9 | | Administrative Code.

10 | | "Special charter district" means any city, township, or |
11 | | district
organized into a school district, under a special Act |
12 | | or charter of the
General Assembly or in which schools are now |
13 | | managed and operating within
such unit in whole or in part |
14 | | under the terms of such special Act or
charter.

17 | | Sec. 10-20.13. Textbooks for children of parents unable to |
18 | | buy them
and other fees and fines . |
19 | | (a) To purchase, at the
expense of the district, a |
20 | | sufficient number of
textbooks for children whose parents are |
21 | | unable to buy them, including
but not limited to children |
22 | | living in households that meet the free lunch or breakfast |
23 | | eligibility guidelines established by the federal government |
24 | | pursuant to Section 1758 of the federal Richard B. Russell |
25 | | National School Lunch Act (42 U.S.C. 1758; 7 C.F.R. 245 et |

1 | | seq.) and homeless children and youth as defined in Section |
2 | | 11434a of the federal McKinney-Vento Homeless Assistance Act |

4 | | subsection (c) of this Section. Such textbooks
shall be loaned |
5 | | only, and the directors shall require the teacher to see
that |
6 | | they are properly cared for and returned at the end of each |
7 | | term of
school.

8 | | (b) To waive all fees and any fines for the loss of school |
9 | | property assessed by the district on children whose parents
|
10 | | are unable to afford them, including but not limited to : |
11 | | (1) children living in households that meet the free |
12 | | lunch or breakfast eligibility guidelines established by |
13 | | the federal government pursuant to Section 1758 of the |
14 | | federal Richard B. Russell National School Lunch Act (42 |
15 | | U.S.C. 1758; 7 C.F.R. 245 et seq.), subject to |
16 | | verification as set forth in subsection (c) of this |
17 | | Section , and |
18 | | (2)homeless children and youth as defined in Section |
19 | | 11434a of the federal McKinney-Vento Homeless Assistance |
20 | | Act (42 U.S.C. 11434a). |
21 | | Notice of waiver availability shall be given to parents or |
22 | | guardians with every bill for fees or fines .
The school board

23 | | shall adopt written policies and procedures for such waiver of |
24 | | fees in
accordance with regulations promulgated by the State |
25 | | Board of Education.

26 | | (c) Any school board that participates in a federally |
|

1 | | funded, school-based child nutrition program and uses a |
2 | | student's application for, eligibility for, or participation |
3 | | in the federally funded, school-based child nutrition program |
4 | | (42 U.S.C. 1758; 7 C.F.R. 245 et seq.) as the basis for waiving |
5 | | fees assessed by the school district must follow the |
6 | | verification requirements of the federally funded, |
7 | | school-based child nutrition program (42 U.S.C. 1758; 7 C.F.R. |
8 | | 245.6a). |
9 | | A school board that establishes a process for the |
10 | | determination of eligibility for waiver of fees assessed by |
11 | | the school district that is completely independent of a |
12 | | student's application for, eligibility for, or participation |
13 | | in a federally funded, school-based child nutrition program |
14 | | may provide for fee waiver verification no more often than |
15 | | once per academic year every 60 calendar days . Information |
16 | | obtained during the independent, fee waiver verification |
17 | | process indicating that the student does not meet free lunch |
18 | | or breakfast eligibility guidelines may be used to deny the |
19 | | waiver of the student's fees or fines for the loss of school |
20 | | property , provided that any information obtained through this |
21 | | independent process for determining or verifying eligibility |
22 | | for fee waivers shall not be used to determine or verify |
23 | | eligibility for any federally funded, school-based child |
24 | | nutrition program. This subsection shall not preclude children |
25 | | from obtaining waivers at any point during the academic year. |

4 | | Sec. 27A-5. Charter school; legal entity; requirements.
|
5 | | (a) A charter school shall be a public, nonsectarian, |
6 | | nonreligious, non-home
based, and non-profit school. A charter |
7 | | school shall be organized and operated
as a nonprofit |
8 | | corporation or other discrete, legal, nonprofit entity
|
9 | | authorized under the laws of the State of Illinois.
|
10 | | (b) A charter school may be established under this Article |
11 | | by creating a new
school or by converting an existing public |
12 | | school or attendance center to
charter
school status.
|
13 | | Beginning on April 16, 2003 (the effective date of Public Act |
14 | | 93-3), in all new
applications to establish
a charter
school |
15 | | in a city having a population exceeding 500,000, operation of |
16 | | the
charter
school shall be limited to one campus. The changes |
17 | | made to this Section by Public Act 93-3 do not apply to charter |
18 | | schools existing or approved on or before April 16, 2003 (the
|
19 | | effective date of Public Act 93-3). |
20 | | (b-5) In this subsection (b-5), "virtual-schooling" means |
21 | | a cyber school where students engage in online curriculum and |
22 | | instruction via the Internet and electronic communication with |
23 | | their teachers at remote locations and with students |
24 | | participating at different times. |
25 | | From April 1, 2013 through December 31, 2016, there is a |

1 | | moratorium on the establishment of charter schools with |
2 | | virtual-schooling components in school districts other than a |
3 | | school district organized under Article 34 of this Code. This |
4 | | moratorium does not apply to a charter school with |
5 | | virtual-schooling components existing or approved prior to |
6 | | April 1, 2013 or to the renewal of the charter of a charter |
7 | | school with virtual-schooling components already approved |
8 | | prior to April 1, 2013.

9 | | (c) A charter school shall be administered and governed by |
10 | | its board of
directors or other governing body
in the manner |
11 | | provided in its charter. The governing body of a charter |
12 | | school
shall be subject to the Freedom of Information Act and |
13 | | the Open Meetings Act. No later than January 1, 2021 (one year |
14 | | after the effective date of Public Act 101-291), a charter |
15 | | school's board of directors or other governing body must |
16 | | include at least one parent or guardian of a pupil currently |
17 | | enrolled in the charter school who may be selected through the |
18 | | charter school or a charter network election, appointment by |
19 | | the charter school's board of directors or other governing |
20 | | body, or by the charter school's Parent Teacher Organization |
21 | | or its equivalent. |
22 | | (c-5) No later than January 1, 2021 (one year after the |
23 | | effective date of Public Act 101-291) or within the first year |
24 | | of his or her first term, every voting member of a charter |
25 | | school's board of directors or other governing body shall |
26 | | complete a minimum of 4 hours of professional development |

1 | | leadership training to ensure that each member has sufficient |
2 | | familiarity with the board's or governing body's role and |
3 | | responsibilities, including financial oversight and |
4 | | accountability of the school, evaluating the principal's and |
5 | | school's performance, adherence to the Freedom of Information |
6 | | Act and the Open Meetings Act, and compliance with education |
7 | | and labor law. In each subsequent year of his or her term, a |
8 | | voting member of a charter school's board of directors or |
9 | | other governing body shall complete a minimum of 2 hours of |
10 | | professional development training in these same areas. The |
11 | | training under this subsection may be provided or certified by |
12 | | a statewide charter school membership association or may be |
13 | | provided or certified by other qualified providers approved by |
14 | | the State Board of Education.
|
15 | | (d) For purposes of this subsection (d), "non-curricular |
16 | | health and safety requirement" means any health and safety |
17 | | requirement created by statute or rule to provide, maintain, |
18 | | preserve, or safeguard safe or healthful conditions for |
19 | | students and school personnel or to eliminate, reduce, or |
20 | | prevent threats to the health and safety of students and |
21 | | school personnel. "Non-curricular health and safety |
22 | | requirement" does not include any course of study or |
23 | | specialized instructional requirement for which the State |
24 | | Board has established goals and learning standards or which is |
25 | | designed primarily to impart knowledge and skills for students |
26 | | to master and apply as an outcome of their education. |

1 | | A charter school shall comply with all non-curricular |
2 | | health and safety
requirements applicable to public schools |
3 | | under the laws of the State of
Illinois. On or before September |
4 | | 1, 2015, the State Board shall promulgate and post on its |
5 | | Internet website a list of non-curricular health and safety |
6 | | requirements that a charter school must meet. The list shall |
7 | | be updated annually no later than September 1. Any charter |
8 | | contract between a charter school and its authorizer must |
9 | | contain a provision that requires the charter school to follow |
10 | | the list of all non-curricular health and safety requirements |
11 | | promulgated by the State Board and any non-curricular health |
12 | | and safety requirements added by the State Board to such list |
13 | | during the term of the charter. Nothing in this subsection (d) |
14 | | precludes an authorizer from including non-curricular health |
15 | | and safety requirements in a charter school contract that are |
16 | | not contained in the list promulgated by the State Board, |
17 | | including non-curricular health and safety requirements of the |
18 | | authorizing local school board.
|
19 | | (e) Except as otherwise provided in the School Code, a |
20 | | charter school shall
not charge tuition; provided that a |
21 | | charter school may charge reasonable fees
for textbooks, |
22 | | instructional materials, and student activities.
|
23 | | (f) A charter school shall be responsible for the |
24 | | management and operation
of its fiscal affairs, including,
but |
25 | | not limited to, the preparation of its budget. An audit of each |
26 | | charter
school's finances shall be conducted annually by an |
|

1 | | outside, independent
contractor retained by the charter |
2 | | school. The contractor shall not be an employee of the charter |
3 | | school or affiliated with the charter school or its authorizer |
4 | | in any way, other than to audit the charter school's finances. |
5 | | To ensure financial accountability for the use of public |
6 | | funds, on or before December 1 of every year of operation, each |
7 | | charter school shall submit to its authorizer and the State |
8 | | Board a copy of its audit and a copy of the Form 990 the |
9 | | charter school filed that year with the federal Internal |
10 | | Revenue Service. In addition, if deemed necessary for proper |
11 | | financial oversight of the charter school, an authorizer may |
12 | | require quarterly financial statements from each charter |
13 | | school.
|
14 | | (g) A charter school shall comply with all provisions of |
15 | | this Article, the Illinois Educational Labor Relations Act, |
16 | | all federal and State laws and rules applicable to public |
17 | | schools that pertain to special education and the instruction |
18 | | of English learners, and
its charter. A charter
school is |
19 | | exempt from all other State laws and regulations in this Code
|
20 | | governing public
schools and local school board policies; |
21 | | however, a charter school is not exempt from the following:
|
22 | | (1) Sections 10-21.9 and 34-18.5 of this Code |
23 | | regarding criminal
history records checks and checks of |
24 | | the Statewide Sex Offender Database and Statewide Murderer |
25 | | and Violent Offender Against Youth Database of applicants |
26 | | for employment;
|

13 | | (h) A charter school may negotiate and contract with a |
14 | | school district, the
governing body of a State college or |
15 | | university or public community college, or
any other public or |
16 | | for-profit or nonprofit private entity for: (i) the use
of a |
17 | | school building and grounds or any other real property or |
18 | | facilities that
the charter school desires to use or convert |
19 | | for use as a charter school site,
(ii) the operation and |
20 | | maintenance thereof, and
(iii) the provision of any service, |
21 | | activity, or undertaking that the charter
school is required |
22 | | to perform in order to carry out the terms of its charter.
|
23 | | However, a charter school
that is established on
or
after |
24 | | April 16, 2003 (the effective date of Public Act 93-3) and that |
25 | | operates
in a city having a population exceeding
500,000 may |
26 | | not contract with a for-profit entity to
manage or operate the |
|

charge a charter |
5 | | school reasonable rent for the use of the district's
|
6 | | buildings, grounds, and facilities. Any services for which a |
7 | | charter school
contracts
with a school district shall be |
8 | | provided by the district at cost. Any services
for which a |
9 | | charter school contracts with a local school board or with the
|
10 | | governing body of a State college or university or public |
11 | | community college
shall be provided by the public entity at |
12 | | cost.
|
13 | | (i) In no event shall a charter school that is established |
14 | | by converting an
existing school or attendance center to |
15 | | charter school status be required to
pay rent for space
that is |
16 | | deemed available, as negotiated and provided in the charter |
17 | | agreement,
in school district
facilities. However, all other |
18 | | costs for the operation and maintenance of
school district |
19 | | facilities that are used by the charter school shall be |
20 | | subject
to negotiation between
the charter school and the |
21 | | local school board and shall be set forth in the
charter.

22 | | (j) A charter school may limit student enrollment by age |
23 | | or grade level.
|
24 | | (k) If the charter school is approved by the State Board or |
25 | | Commission, then the charter school is its own local education |
26 | | agency. |

10 | | To ensure financial accountability for the use of public |
11 | | funds, on or before December 1 of every year of operation, each |
12 | | charter school shall submit to its authorizer and the State |
13 | | Board a copy of its audit and a copy of the Form 990 the |
14 | | charter school filed that year with the federal Internal |
15 | | Revenue Service. In addition, if deemed necessary for proper |
16 | | financial oversight of the charter school, an authorizer may |
17 | | require quarterly financial statements from each charter |
18 | | school.

19 | | (g) A charter school shall comply with all provisions of |
20 | | this Article, the Illinois Educational Labor Relations Act, |
21 | | all federal and State laws and rules applicable to public |
22 | | schools that pertain to special education and the instruction |
23 | | of English learners, and
its charter. A charter

manage or operate the |
6 | | school during the period that commences on April 16, 2003 (the

pay rent for space

13 | | Sec. 27A-5. Charter school; legal entity; requirements.

14 | | (a) A charter school shall be a public, nonsectarian, |
15 | | nonreligious, non-home
based, and non-profit school. A charter |
16 | | school shall be organized and operated
as a nonprofit |
17 | | corporation or other discrete, legal, nonprofit entity
|
18 | | authorized under the laws of the State of Illinois.
|
19 | | (b) A charter school may be established under this Article |
20 | | by creating a new
school or by converting an existing public |
21 | | school or attendance center to
charter
school status.
|
22 | | Beginning on April 16, 2003 (the effective date of Public Act |
23 | | 93-3), in all new
applications to establish
a charter
school |
24 | | in a city having a population exceeding 500,000, operation of |
25 | | the
charter
school shall be limited to one campus. The changes |

4 | | (b-5) In this subsection (b-5), "virtual-schooling" means |
5 | | a cyber school where students engage in online curriculum and |
6 | | instruction via the Internet and electronic communication with |
7 | | their teachers at remote locations and with students |
8 | | participating at different times. |
9 | | From April 1, 2013 through December 31, 2016, there is a |
10 | | moratorium on the establishment of charter schools with |
11 | | virtual-schooling components in school districts other than a |
12 | | school district organized under Article 34 of this Code. This |
13 | | moratorium does not apply to a charter school with |
14 | | virtual-schooling components existing or approved prior to |
15 | | April 1, 2013 or to the renewal of the charter of a charter |
16 | | school with virtual-schooling components already approved |
17 | | prior to April 1, 2013.

18 | | (c) A charter school shall be administered and governed by |
19 | | its board of
directors or other governing body
in the manner |
20 | | provided in its charter. The governing body of a charter |
21 | | school
shall be subject to the Freedom of Information Act and |
22 | | the Open Meetings Act. No later than January 1, 2021 (one year |
23 | | after the effective date of Public Act 101-291), a charter |
24 | | school's board of directors or other governing body must |
25 | | include at least one parent or guardian of a pupil currently |
26 | | enrolled in the charter school who may be selected through the |

1 | | charter school or a charter network election, appointment by |
2 | | the charter school's board of directors or other governing |
3 | | body, or by the charter school's Parent Teacher Organization |
4 | | or its equivalent. |
5 | | (c-5) No later than January 1, 2021 (one year after the |
6 | | effective date of Public Act 101-291) or within the first year |
7 | | of his or her first term, every voting member of a charter |
8 | | school's board of directors or other governing body shall |
9 | | complete a minimum of 4 hours of professional development |
10 | | leadership training to ensure that each member has sufficient |
11 | | familiarity with the board's or governing body's role and |
12 | | responsibilities, including financial oversight and |
13 | | accountability of the school, evaluating the principal's and |
14 | | school's performance, adherence to the Freedom of Information |
15 | | Act and the Open Meetings Act, and compliance with education |
16 | | and labor law. In each subsequent year of his or her term, a |
17 | | voting member of a charter school's board of directors or |
18 | | other governing body shall complete a minimum of 2 hours of |
19 | | professional development training in these same areas. The |
20 | | training under this subsection may be provided or certified by |
21 | | a statewide charter school membership association or may be |
22 | | provided or certified by other qualified providers approved by |
23 | | the State Board of Education.

24 | | (d) For purposes of this subsection (d), "non-curricular |
25 | | health and safety requirement" means any health and safety |
26 | | requirement created by statute or rule to provide, maintain, |

1 | | preserve, or safeguard safe or healthful conditions for |
2 | | students and school personnel or to eliminate, reduce, or |
3 | | prevent threats to the health and safety of students and |
4 | | school personnel. "Non-curricular health and safety |
5 | | requirement" does not include any course of study or |
6 | | specialized instructional requirement for which the State |
7 | | Board has established goals and learning standards or which is |
8 | | designed primarily to impart knowledge and skills for students |
9 | | to master and apply as an outcome of their education. |
10 | | A charter school shall comply with all non-curricular |
11 | | health and safety
requirements applicable to public schools |
12 | | under the laws of the State of
Illinois. On or before September |
13 | | 1, 2015, the State Board shall promulgate and post on its |
14 | | Internet website a list of non-curricular health and safety |
15 | | requirements that a charter school must meet. The list shall |
16 | | be updated annually no later than September 1. Any charter |
17 | | contract between a charter school and its authorizer must |
18 | | contain a provision that requires the charter school to follow |
19 | | the list of all non-curricular health and safety requirements |
20 | | promulgated by the State Board and any non-curricular health |
21 | | and safety requirements added by the State Board to such list |
22 | | during the term of the charter. Nothing in this subsection (d) |
23 | | precludes an authorizer from including non-curricular health |
24 | | and safety requirements in a charter school contract that are |
25 | | not contained in the list promulgated by the State Board, |
26 | | including non-curricular health and safety requirements of the |

1 | | authorizing local school board.
|
2 | | (e) Except as otherwise provided in the School Code, a |
3 | | charter school shall
not charge tuition; provided that a |
4 | | charter school may charge reasonable fees
for textbooks, |
5 | | instructional materials, and student activities.
|
6 | | (f) A charter school shall be responsible for the |
7 | | management and operation
of its fiscal affairs, including,
but |
8 | | not limited to, the preparation of its budget. An audit of each |
9 | | charter
school's finances shall be conducted annually by an |
10 | | outside, independent
contractor retained by the charter |
11 | | school. The contractor shall not be an employee of the charter |
12 | | school or affiliated with the charter school or its authorizer |
13 | | in any way, other than to audit the charter school's finances. |

5 | | (a) The board shall waive all fees and any fines for the |

10 | | lunch or breakfast eligibility guidelines established by |
11 | | the federal government pursuant to Section 1758 of the |
12 | | federal Richard B. Russell National School Lunch Act (42 |
13 | | U.S.C. 1758; 7 C.F.R. 245 et seq.), subject to |
14 | | verification as set forth in subsection (b) of this |
15 | | Section , and |
16 | | (2) homeless children and youth as defined in Section |
17 | | 11434a of the federal McKinney-Vento Homeless Assistance |
18 | | Act (42 U.S.C. 11434a). |
19 | | Notice of waiver availability shall be given to parents or |
20 | | guardians with every bill for fees or fines . The board shall |
21 | | develop written
policies and procedures implementing this |
22 | | Section in accordance with
regulations promulgated by the |
23 | | State Board of Education.

24 | | (b) If the board participates in a federally funded, |
25 | | school-based child nutrition program and uses a student's |

1 | | application for, eligibility for, or participation in the |
2 | | federally funded, school-based child nutrition program (42 |
3 | | U.S.C. 1758; 7 C.F.R. 245 et seq.) as the basis for waiving |
4 | | fees assessed by the district, then the board must follow the |
5 | | verification requirements of the federally funded, |
6 | | school-based child nutrition program (42 U.S.C. 1758; 7 C.F.R. |
7 | | 245.6a). |
8 | | If the board establishes a process for the determination |
9 | | of eligibility for waiver of all fees assessed by the district |
10 | | that is completely independent of the criteria listed in |
11 | | subsection (b) a student's application for, eligibility for, |
12 | | or participation in a federally funded, school-based child |
13 | | nutrition program , the board may provide for fee waiver |
14 | | verification no more often once every academic year than every |
15 | | 60 calendar days . Information obtained during the independent , |
16 | | fee waiver verification process indicating that the student |
17 | | does not meet free lunch or breakfast eligibility guidelines |
18 | | may be used to deny the waiver of the student's fees or fines |
19 | | for the loss of school property , provided that any information |
20 | | obtained through this independent process for determining or |
21 | | verifying eligibility for fee waivers shall not be used to |
22 | | determine or verify eligibility for any federally funded, |
23 | | school-based child nutrition program. |
24 | | This subsection shall not preclude children from obtaining |
25 | | waivers at any point during the academic year. |
