Amends the Wildlife Code. Provides that the Department of Natural Resources shall encourage the owners of structures to eliminate nonflashing (steady burning) L-810 lights by a January 1, 2024. Provides that the owners of structures constructed on or after March 1, 2022 that are located within migratory flyways, or in ecologically sensitive areas, or are within one mile of a forest preserve or federal or State park or wildlife area shall turn off all lights not required for safety or maintenance between 12:00am through 7:00am during migratory seasons. Provides the Department of Natural Resources with rulemaking authority. Effective immediately.

1 | | AN ACT concerning wildlife.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Wildlife Code is amended by adding Section |
5 | | 3.41 as follows: |
6 | | (520 ILCS 5/3.41 new) |
7 | | Sec. 3.41. Navigational lighting. Notwithstanding any |
8 | | provision of law to the contrary: |
9 | | (a) The Department shall encourage the owners of |
10 | | structures to eliminate nonflashing (steady burning) L-810 |
11 | | lights by a January 1, 2024. The Department shall issue |
12 | | certificates of recognition to owners for eliminating |
13 | | nonflashing (steady burning) L-810 lights. |
14 | | (b) Structures constructed on or after March 1, 2022 that |
15 | | are located within migratory flyways, or in ecologically |
16 | | sensitive areas (as the Department shall determine), or are |
17 | | within one mile of a forest preserve or federal or State park |
18 | | or wildlife area shall turn off all lights not required for |
19 | | safety or maintenance between 12:00am through 7:00am during |
20 | | migratory seasons. The Department shall determine the dates of |
21 | | such migratory seasons and shall publish those dates at least |
22 | | 6 months in advance on the Department's Internet website. |
23 | | (c) The Department may adopt such rules as it deems |
