1 | | Sec. 1.5. Federal regulations; operation of Act. |
2 | | (a) Except as provided in subsection (b), Sections 1 |
3 | | through 6 of this Act are inoperative on and after the |
4 | | effective date of this amendatory Act of the 102nd General |
5 | | Assembly. |
6 | | (b) If at any time the Safety and Health Regulations for |
7 | | Construction standards at 29 CFR 1926.800 through 29 CFR |
8 | | 1926.804 are repealed or revoked, the Director of Labor shall |
9 | | adopt a rule setting forth a determination that this Act |
10 | | should be reviewed and reinstated, in whole or in part, in |
11 | | order to protect the health and safety of Illinois' workers. |
12 | | On the date such a rule is adopted, this Act shall again become |
13 | | operative. |
14 | | Section 15. The Underground Sewer Employee Safety Act is |
15 | | amended by changing Section 1 and by adding Section 0.05 as |
16 | | follows: |

19 | | (a) Except as provided in subsection (b), Sections 1 |
20 | | through 6 of this Act are inoperative on and after the |

23 | | (b) If at any time the Occupational Safety and Health |
24 | | standards at 29 CFR 1910.120, 29 CFR 1910.146 or the Safety and |

1 | | Health Regulations for Construction standards 29 CFR 1926.1201 |
2 | | through 29 CFR 1926.1213 are repealed or revoked, the Director |
3 | | of Labor shall adopt a rule setting forth a determination that |
4 | | this Act should be reviewed and reinstated, in whole or in |
5 | | part, in order to protect the health and safety of Illinois' |
6 | | workers. On the date such a rule is adopted, this Act shall |
7 | | again become operative.

9 | | Sec. 1.
This Act shall apply to all employers engaged in |
10 | | any occupation,
business or enterprise in this State, |
11 | | including the State of Illinois and
its political |
12 | | subdivisions , except that in the event of a conflict between
|
13 | | this Act and any other Federal or State law or regulation |
14 | | concerning health
and safety of employees, such other law or |
15 | | regulation shall control .

17 | | Section 20. The Toxic Substances Disclosure to Employees |
18 | | Act is amended by changing Section 1.5 as follows: |

22 | | through 17 of this Act are inoperative on and after the |

1 | | General Assembly , and the Department of Labor shall instead |
2 | | enforce the Occupational Safety and Health Administration |
3 | | Hazard Communication standards at 29 CFR 1910.1200, as |
4 | | amended .

5 | | (b) If at any time the Occupational Safety and Health |
6 | | Administration Hazard Communication standard at 29 CFR |
7 | | 1910.1200 is repealed or revoked, the Director of Labor shall |
8 | | adopt a rule setting forth a determination that this Act |
9 | | should be reviewed and reinstated in order to protect the |
10 | | health and safety of Illinois' public sector workers. On the |
11 | | date such a rule is adopted, this Act shall again become |
12 | | operative.
