Amends the Illinois Procurement Code. Provides that no State agency shall use or purchase for use styrofoam-based products for use in providing food services. Provides that non-styrofoam-based alternatives may be
purchased for the purposes of providing food services as a
replacement for the prohibited styrofoam-based products. Provides that any surplus supplies remaining as a result of the requirement may be transferred or donated for use by other food service entities. Defines "State agency".

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Procurement Code is amended by |
5 | | adding Section 25-90 as follows: |
6 | | (30 ILCS 500/25-90 new) |
7 | | Sec. 25-90. Styrofoam-based product ban. Notwithstanding |
8 | | any provision of law to the contrary, no State agency shall use |
9 | | or purchase for use styrofoam-based products for use in |
10 | | providing food services. Non-styrofoam-based alternatives may |
11 | | be
purchased for the purposes of providing food services as a
|
12 | | replacement for the prohibited styrofoam-based products. Any |
13 | | surplus supplies remaining as a result of the requirements of |
14 | | this Section may be transferred or donated for use by other |
15 | | food service entities. |
16 | | For the purposes of this Section, "State agency" has the |
17 | | meaning provided under Section 1-7 of the Illinois State |
18 | | Auditing Act.
