SYNOPSIS AS INTRODUCED:

    Amends the Illinois Income Tax Act. Provides that all individual income tax return forms shall contain an appropriate space in which the taxpayer may indicate that the Department of Revenue may share the taxpayer's income information with other State agencies in order to determine the taxpayer's eligibility for health insurance benefits. Provides that the Department shall provide the Department of Healthcare and Family Services and the Department of Insurance with the individual income tax information collected as soon as practicable. Amends the Illinois Insurance Code. Provides that the Department of Insurance shall use taxpayer income information provided by the Department of Revenue to determine if an individual is eligible for a premium tax credit under the Patient Protection and Affordable Care Act. Provides that if the individual is determined to be eligible for a premium tax credit, the Department shall notify the individual of his or her eligibility as soon as practicable. Provides that the Department shall inform the individual of the next open enrollment period in the federal health insurance marketplace, and shall inform the individual of the special enrollment period triggered by a qualifying life event. Provides that if a State health benefits exchange is established in the State, an individual determined to be eligible for a premium tax credit shall be eligible to enroll in a qualified health plan through the State health benefits exchange during a special enrollment period that shall expire 60 days after the individual is notified by the Department of his or her eligibility for a premium tax credit. Makes other changes. Amends the Illinois Public Aid Code. Provides that the Department of Healthcare and Family Services shall use taxpayer income information provided by the Department of Revenue to determine if an individual is eligible for health benefits provided by any program administered by the Department. Provides that if the individual is determined to be eligible for health benefits, the Department shall notify the individual of his or her eligibility as soon as practicable.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Income Tax Act is amended by
5adding Section 513 as follows:
 
6    (35 ILCS 5/513 new)
7    Sec. 513. Health benefits; easy enrollment program.
8    (a) All individual income tax return forms shall contain
9an appropriate space in which the taxpayer may indicate that
10the Department may share the taxpayer's income information
11with other State agencies in order to determine the taxpayer's
12eligibility for health insurance benefits.
13    (b) The Department shall provide the Department of
14Healthcare and Family Services and the Department of Insurance
15with individual income tax information collected pursuant to
16subsection (a) as soon as practicable.
 
17    Section 10. The Illinois Insurance Code is amended by
18adding Section 368h as follows:

20    Sec. 368h. Premium credit eligibility; easy enrollment

1    (a) The Department shall use taxpayer income information
2provided by the Department of Revenue to determine if an
3individual is eligible for a premium tax credit under the
4Patient Protection and Affordable Care Act.
5    (b) If the individual is determined to be eligible for a
6premium tax credit under subsection (a), the Department shall
7notify the individual of his or her eligibility as soon as
8practicable. The Department shall inform the individual of the
9next open enrollment period in the federal health insurance
10marketplace and shall inform the individual of the special
11enrollment period triggered by a qualifying life event. If the
12individual does not have a qualifying life event, the
13Department shall inform the individual of other options for
14health insurance.
15    (c) If, in accordance with Section 1311 of the Patient
16Protection and Affordable Care Act, a State health benefits
17exchange is established in this State, an individual
18determined to be eligible for a premium tax credit under
19subsection (a) shall be eligible to enroll in a qualified
20health plan through the State health benefits exchange during
21a special enrollment period that shall expire 60 days after
22the individual is notified by the Department of his or her
23eligibility for a premium tax credit under subsection (b).
 
24    Section 15. The Illinois Public Aid Code is amended by
25adding Section 5-2c as follows:

2    Sec. 5-2c. Health benefits eligibility; easy enrollment
3program.
4    (a) The Department shall use taxpayer income information
5provided by the Department of Revenue to determine if an
6individual is eligible for health benefits provided by any
7program administered by the Department, including the medical
8assistance program under this Article, the Children's Health
9Insurance Program, or the Covering ALL KIDS Health Insurance
10Program.
11    (b) If the individual is determined to be eligible for
12health benefits under subsection (a), the Department shall
13notify the individual of his or her eligibility as soon as
14practicable.
