SYNOPSIS AS INTRODUCED:
 
30 ILCS 595/10

    Amends the Local Food, Farms, and Jobs Act. Requires that at least 20% (currently, 10%) of food and food products purchased by State-funded entities be local farm or food products. Provides that of the 20% of local farm or food products required to be purchased by State agencies and State-funded entities under the Act, at least 10% of the local farm or food products shall be purchased from minority-owned food producers. Makes other changes. Effective immediately.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Local Food, Farms, and Jobs Act is amended
5by changing Section 10 as follows:
 
6    (30 ILCS 595/10)
7    Sec. 10. Procurement goals for local farm or food
8products.
9    (a) In order to create, strengthen, and expand local farm
10and food economies throughout Illinois, it shall be the goal
11of this State that 20% of all food and food products purchased
12by State agencies and State-owned facilities, including,
13without limitation, facilities for persons with mental health
14and developmental disabilities, correctional facilities, and
15public universities, shall, by 2020 onward, be local farm or
16food products.
17    (a-5) Of the 20% of local farm or food products required to
18be purchased by State agencies under subsection (a), at least
1910% of the local farm or food products shall be purchased from
20minority-owned food producers.
21    (b) The Local Food, Farms, and Jobs Council established
22under this Act shall require that at least 20% support and
23encourage that 10% of food and food products purchased by

1entities funded in part or in whole by State dollars, which
2spend funds more than $25,000 per year on food or food products
3for its students, residents, or clients, including, without
4limitation, public schools, child care facilities,
5after-school programs, and hospitals, shall, by 2023 onward
62020, be local farm or food products.
7    (b-5) Of the 20% of local farm or food products required to
8be purchased by State-funded entities under subsection (b), at
9least 10% of the local farm or food products shall be purchased
10from minority-owned food producers.
11    (c) To meet the goals set forth in this Section, when a
12State contract for purchase of food or food products is to be
13awarded to the lowest responsible bidder, an otherwise
14qualified bidder who will fulfill the contract through the use
15of local farm or food products may be given preference over
16other bidders, provided that the cost included in the bid of
17local farm or food products is not more than 10% greater than
18the cost included in a bid that is not for local farm or food
19products.
20    (d) All State agencies and State-owned facilities that
21purchase food and food products shall, with the assistance of
22the Local Food, Farms, and Jobs Council, develop a system for
23(i) identifying the percentage of local farm or food products
24purchased for fiscal year 2011 as the baseline; and (ii)
25tracking and reporting local farm or food products purchases
26on an annual basis.
