SYNOPSIS AS INTRODUCED:
 
20 ILCS 1605/7.12

    Amends the Illinois Lottery Law. Allows the Department of the Lottery to offer interactive instant win games through the Internet program. Requires the private manager to obtain the Director of the Lottery's approval before commencing the interactive instant win games program. Defines "interactive instant win game". Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Lottery Law is amended by changing
5Section 7.12 as follows:
 
6    (20 ILCS 1605/7.12)
7    (Section scheduled to be repealed on July 1, 2022)
8    Sec. 7.12. Internet program.
9    (a) The General Assembly finds that:
10        (1) the consumer market in Illinois has changed since
11    the creation of the Illinois State Lottery in 1974;
12        (2) the Internet has become an integral part of
13    everyday life for a significant number of Illinois
14    residents not only in regards to their professional life,
15    but also in regards to personal business and
16    communication; and
17        (3) the current practices of selling lottery tickets
18    does not appeal to the new form of market participants who
19    prefer to make purchases on the Internet at their own
20    convenience.
21    It is the intent of the General Assembly to create an
22Internet program for the sale of lottery tickets to capture
23this new form of market participant.

1    (b) The Department shall create a program that allows an
2individual 18 years of age or older to purchase lottery
3tickets or shares on the Internet without using a Lottery
4retailer with on-line status, as those terms are defined by
5rule. The Department shall restrict the sale of lottery
6tickets on the Internet to transactions initiated and received
7or otherwise made exclusively within the State of Illinois.
8The Department shall adopt rules necessary for the
9administration of this program. These rules shall include,
10among other things, requirements for marketing of the Lottery
11to infrequent players, as well as limitations on the purchases
12that may be made through any one individual's lottery account.
13The provisions of this Act and the rules adopted under this Act
14shall apply to the sale of lottery tickets or shares under this
15program.
16    The Department is obligated to implement the program set
17forth in this Section and Sections 7.15 and 7.16. The
18Department may offer Lotto, Lucky Day Lotto, Mega Millions,
19Powerball, Pick 3, Pick 4, and other draw games that are
20offered at retail locations, as well as interactive instant
21win games, through the Internet program. The private manager
22shall obtain the Director's approval before providing any draw
23games or commencing the interactive instant win games program.
24The Department shall make interactive instant win games
25available for sale exclusively at retail locations by lottery
26licensees pursuant to the Department's rules for 6 months

1following the initial launch date to enhance the Department's
2revenue growth from retail sales. Thereafter, the Department
3shall concurrently offer interactive instant win games over
4the Internet and in retail locations. The Department shall not
5offer any interactive instant win game that qualifies as a
6"gambling game", as that term is defined in Section 4 of the
7Illinois Gambling Act. As used in this Section, "interactive
8instant win game" means a virtual Lottery instant game with
9specified prize structures and set odds that does not include
10an instant-reveal function that immediately reveals the
11outcome of the game. Any draw game tickets that are approved
12for sale by lottery licensees are automatically approved for
13sale through the Internet program. The Department shall
14maintain responsible gaming controls in its policies.
15    The Department shall authorize the private manager to
16implement and administer the program pursuant to the
17management agreement entered into under Section 9.1 and in a
18manner consistent with the provisions of this Section. If a
19private manager has not been selected pursuant to Section 9.1
20at the time the Department is obligated to implement the
21program, then the Department shall not proceed with the
22program until after the selection of the private manager, at
23which time the Department shall authorize the private manager
24to implement and administer the program pursuant to the
25management agreement entered into under Section 9.1 and in a
26manner consistent with the provisions of this Section.

1    Nothing in this Section shall be construed as prohibiting
2the Department from implementing and operating a website
3portal whereby individuals who are 18 years of age or older
4with an Illinois mailing address may apply to purchase lottery
5tickets via subscription. Nothing in this Section shall also
6be construed as prohibiting the Lottery draw game tickets or
7interactive instant win games authorized for sale through the
8Internet program under this Section from also continuing to be
9sold at retail locations by a lottery licensee pursuant to the
10Department's rules.
11    (c) (Blank).
12    (d) This Section is repealed on July 1, 2022.

15    Section 99. Effective date. This Act takes effect upon
16becoming law.
