AMENDMENT TO HOUSE BILL 4848

2    AMENDMENT NO. ______. Amend House Bill 4848 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Insurance Code is amended by
5adding Section 388h as follows:
 
6    (215 ILCS 5/388h new)
7    Sec. 388h. Opioid antagonists; Liquor Control Act of 1934.
8An insurer may not increase the amount of an insured's premium
9based on the insured's compliance with Section 6-39 of the
10Liquor Control Act of 1934.
 
11    Section 10. The Liquor Control Act of 1934 is amended by
12adding Section 6-39 as follows:
 
13    (235 ILCS 5/6-39 new)
14    Sec. 6-39. Opioid antagonists on premises.

1    (a) In this Section, "music venue" means an indoor or
2outdoor location with a capacity of more than 800 persons used
3as a space to hold a live concert or musical performance.
4    (b) If a licensee operates as a music venue, the licensee
5shall ensure that, during its hours of operation as a music
6venue, it has opioid antagonists available at the premises and
7that there is a staff member on the premises who has been
8sufficiently trained on how to properly administer an opioid
9antagonist. A person who has been certified in the
10administration of opioid antagonists by a governmental or
11private entity, regardless of when the person received that
12certification, is deemed to be sufficiently trained under this
13Section.
14    (c) Any person who, in good faith, administers or provides
15an opioid antagonist in accordance with this Section, shall
16not, as a result of his or her acts or omissions, except
17willful or wanton misconduct on the part of the person, in
18administering or providing the opioid antagonist, be liable
19for civil damages.
 
20    Section 99. Effective date. This Act takes effect June 1,
212023.".
