1 | | of the school being reviewed and any schools with |
2 | | contiguous boundaries to the school being reviewed; |
3 | | (D) geographic barriers; |
4 | | (E) travel time and distance to the school; and |
5 | | (F) program considerations of the school being |
6 | | reviewed and any schools with contiguous boundaries to |
7 | | the school being reviewed. |
8 | | (2) DSP shall submit a written report of its findings, |
9 | | conclusions, and recommendations to the chief executive |
10 | | officer and the Board. The report shall document the |
11 | | evaluation of the factors of the school being reviewed. |
12 | | The report shall be made public on the district's website |
13 | | within 30 days after its completion. |
14 | | (b) If it is determined that there is a need to revise any |
15 | | existing boundaries, DSP shall develop and recommend any |
16 | | proposed changes to the chief executive officer prior to the |
17 | | beginning of the school year in which the changes are to take |
18 | | effect. In addition, DSP shall develop and recommend proposed |
19 | | boundaries for new schools to the chief executive officer |
20 | | prior to the beginning of the school year in which the new |
21 | | school boundaries are to take effect. |
22 | | (1) In developing proposed changes to boundaries for |
23 | | existing schools and proposing attendance boundaries for |
24 | | new schools, DSP shall consider a range of factors, |
25 | | including the following: |
26 | | (A) DSP shall consider the capacities of each of |

1 | | the schools involved in the proposed boundary |
2 | | revisions, including the extent
to which a school is |
3 | | overcrowded or underutilized. Where feasible, the goal |
4 | | is for elementary schools to
be utilized at not more |
5 | | than 80% of design capacity and for high schools at not |
6 | | more than 100% of program capacity. Schools shall be |
7 | | considered severely overcrowded if they are
operating |
8 | | in excess of 100% utilization and significantly |
9 | | underutilized if they are operating at less than 30% |
10 | | utilization. DSP shall consider these utilization |
11 | | rates when proposing revisions to attendance |
12 | | boundaries for
existing schools and when proposing |
13 | | attendance boundaries for new schools. |
14 | | (B) DSP shall consider the current and projected |
15 | | racial and ethnic composition of the schools affected. |
16 | | Where feasible, DSP shall propose establishing or |
17 | | revising attendance boundaries to maintain or promote
|
18 | | stably desegregated enrollments in each of the |
19 | | affected schools and to avoid the creation of one-race
|
20 | | schools. |
21 | | (C) DSP shall consider geographic barriers so as |
22 | | to promote safety and minimize transportation burdens, |
23 | | to the extent feasible. |
24 | | (D) DSP shall consider travel time and distance |
25 | | and, to the extent feasible, seek to minimize travel |
26 | | time and distance. |

1 | | (E) DSP shall consider the placement of programs |
2 | | in each of the schools
involved, such as programs for |
3 | | English learners and for special education students. |
4 | | In addition, DSP shall consider the impact of magnet |
5 | | schools and programs and the requirements of the |
6 | | federal Every Student Succeeds Act and the Illinois |
7 | | Balanced Accountability Measures. |
8 | | (2) For each proposed attendance boundary, DSP shall |
9 | | develop at least 2 alternatives. For each alternative, DSP |
10 | | shall prepare a report showing 3-year enrollment |
11 | | projections by racial and ethnic groups for all schools |
12 | | affected by the proposed change pursuant to each |
13 | | alternative. The report shall document for each |
14 | | alternative the impact on the affected schools for the |
15 | | factors of capacity, geographic barriers, travel time and |
16 | | distance, and program considerations. In developing |
17 | | alternatives, DSP shall consider whether any feasible |
18 | | alternatives would better maintain or promote stably |
19 | | desegregated enrollments in each of the affected schools |
20 | | or better avoid the creation of one-race schools. The |
21 | | report shall be made public on the district's website |
22 | | within 30 days after its completion. |
23 | | (c) The chief executive officer shall review the report |
24 | | from DSP and may suggest additional alternatives. The chief |
25 | | executive officer shall report to the Board if he or she |
26 | | recommends any changes to existing boundaries or establishing |

1 | | boundaries for new schools. If the chief executive officer is |
2 | | recommending any changes to existing boundaries or |
3 | | establishing any boundaries for new schools, the chief |
4 | | executive officer shall provide the Board with a report of the |
5 | | alternatives considered, including data on the factors of |
6 | | capacity, current and projected racial and ethnic |
7 | | considerations, geographic barriers, travel time and distance, |
8 | | and program considerations. The chief executive officer shall |
9 | | inform the Board of the alternative that is being recommended. |
10 | | The report shall be made public on the district's website |
11 | | within 30 days after its completion. |
12 | | (d) Prior to taking action on the establishment or |
13 | | revision of any attendance boundaries, the Board shall conduct |
14 | | public hearings on the proposed establishment or revision of |
15 | | attendance boundaries and the chief executive officer's |
16 | | recommendation. Prior to the public hearing, the Board shall |
17 | | make available reports and data on the factors of capacity, |
18 | | current and projected racial and ethnic considerations, |
19 | | geographic barriers, travel time and distance, and program |
20 | | considerations. In making its decision, the Board shall |
21 | | consider the factors of capacity, current and projected racial |
22 | | and ethnic considerations,
