Amends the Autism Spectrum Disorders Reporting Act. Provides that, no later than December 31st of each year, the Department of Human Services shall submit a report to the General Assembly regarding access to applied behavior analysis therapy for people diagnosed with autism spectrum disorders. Requires the Department of Healthcare and Family Services and the Department of Insurance to provide all necessary data upon request to the Department of Human Services to facilitate the timely and accurate completion of the report. Sets forth information that the report shall include.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Autism Spectrum Disorders Reporting Act is |
5 | | amended by adding Section 32 as follows: |
6 | | (410 ILCS 201/32 new) |
7 | | Sec. 32. Reporting; access to applied behavior analysis. |
8 | | No later than December 31st of each year, the Department of |
9 | | Human Services shall submit a report to the General Assembly |
10 | | regarding access to applied behavior analysis therapy for |
11 | | people diagnosed with autism spectrum disorders. The |
12 | | Department of Healthcare and Family Services and the |
13 | | Department of Insurance shall provide all necessary data upon |
14 | | request to the Department of Human Services to facilitate the |
15 | | timely and accurate completion of this report. The report |
16 | | shall include, but is not limited to, the following |
17 | | information: |
18 | | (1) The best data available regarding the number of |
19 | | individuals in the State of Illinois trained and qualified |
20 | | to provide applied behavior analysis therapy services, |
21 | | and, in doing so, to supervise behavior technicians in the |
22 | | implementation of applied behavior analysis treatment |
23 | | plans. |

1 | | (2) The number of individuals in the State of Illinois |
2 | | meeting the description in paragraph (1) who are enrolled |
3 | | with the Department of Healthcare and Family Services as |
4 | | providers of such covered services under the Medicaid |
5 | | Early and Periodic Screening, Diagnosis, and Treatment |
6 | | (EPSDT) category. |
7 | | (3) The best data available regarding the number of |
8 | | Medicaid-enrolled children in the State of Illinois with |
9 | | an autism spectrum disorder diagnosis, both in total and |
10 | | as calculated by available demographic data, which may |
11 | | include geographic region, race, age, and gender. |
12 | | (4) The number of Medicaid-enrolled children in |
13 | | Illinois, in total and within each demographic subgroup |
14 | | described in paragraph (3), receiving applied behavior |
15 | | analysis therapy services. |
16 | | (5) The number of appeals for denial or lack of access |
17 | | to applied behavior analysis therapy for Medicaid-enrolled |
18 | | children with an autism spectrum disorder diagnosis. |
19 | | (6) The number of children under age 21 in the State of |
20 | | Illinois with an autism spectrum disorder diagnosis |
21 | | receiving the benefit of applied behavior analysis therapy |
22 | | from their commercial insurance provider, both in total |
23 | | and as calculated by available demographic data, which may |
24 | | include different geographic region, race, age, and |
25 | | gender. |
26 | | (7) An analysis identifying areas of inequitable |

1 | | access to applied behavior analysis therapy for children |
2 | | with autism spectrum disorder in Medicaid and commercial |
3 | | insurance, in total and based upon available demographic |
4 | | data, which may include geographic region, race, age, and |
5 | | gender. |
6 | | (8) Recommendations for an action plan to be |
7 | | implemented in the following year, which shall include, |
8 | | but not be limited to: |
9 | | (A) requirements for targeted growth in provider |
10 | | network adequacy that will create meaningful access to |
11 | | applied behavior analysis therapy for children |
12 | | enrolled in Medicaid; and |
13 | | (B) requirements to create and make easily |
14 | | accessible low-literacy materials that will inform and |
15 | | educate parents of children with autism spectrum |
16 | | disorder who are enrolled in Medicaid and eligible to |
17 | | receive applied behavior analysis therapy treatment |
18 | | about this benefit and how to access it.
