Amends the Department of Natural Resources Act, the Historic Preservation Act, and the Illinois State Agency Historic Resources Preservation Act. Requires the Illinois State Museum and Division of Historic Preservation of the Department of Natural Resources to collaborate and assist the Department of Resources exercise its duties under the Acts. Removes authority of Board of the Illinois State Museum to approve budget requests of the Illinois State Museum. Replaces references to the Historic Sites and Preservation Division of the Department with the Department of Natural Resources. Makes other changes. Effective Immediately.

1 | | AN ACT concerning State government.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Department of Natural Resources Act is |
5 | | amended by changing Sections 1-25 and 20-10 as follows:
|
6 | | (20 ILCS 801/1-25)
|
7 | | Sec. 1-25. Powers of the State Museum.
In addition to its |
8 | | other powers and duties, the Department shall
have the |
9 | | following powers and duties which shall be performed by the
|
10 | | State Museum:
|
11 | | (1) To investigate and study the natural resources of |
12 | | the State and
to prepare printed reports and furnish |
13 | | information fundamental to the
conservation and |
14 | | development of natural resources and for that purpose
the |
15 | | officers and employees thereof may, pursuant to rule |
16 | | adopted by the
Department, enter and cross all lands in |
17 | | this State, doing
no damage to private property.

18 | | (2) To cooperate with and advise departments having |
19 | | administrative
powers and duties relating to the natural |
20 | | resources of the State, and to
cooperate with similar |
21 | | departments in other states and with the United
States |
22 | | Government.
|
23 | | (3) To cooperate with the Illinois State Academy of |
|

1 | | Science and to
publish a suitable number of the results of |
2 | | the investigations and
research in the field of natural |
3 | | science to the end that the same may be
distributed to the |
4 | | interested public.

5 | | (4) To maintain a State Museum, and to collect and |
6 | | preserve objects
of scientific and artistic value, |
7 | | representing past and present fauna
and flora, the life |
8 | | and work of man, geological history, natural
resources, |
9 | | and the manufacturing and fine arts; to interpret for and
|
10 | | educate the public concerning the foregoing.
|
11 | | (5) To cooperate with the Illinois State Museum |
12 | | Society for the
mutual benefit of the Museum and the |
13 | | Society, with the Museum furnishing
necessary space for |
14 | | the Society to carry on its functions and keep its
|
15 | | records, and, upon the recommendation of the Museum |
16 | | Director with the
approval of the Board of State Museum |
17 | | Advisors and the Director of the
Department, to enter into |
18 | | agreements with the Illinois State Museum
Society for the |
19 | | operation of a sales counter and other concessions for
the |
20 | | mutual benefit of the Museum and the Society.

21 | | (6) To accept grants of property and to hold property |
22 | | to be
administered as part of the State Museum for the |
23 | | purpose of
preservation, research of interpretation of |
24 | | significant areas within the
State for the purpose of |
25 | | preserving, studying and interpreting
archaeological and |
26 | | natural phenomena.

1 | | (7) To contribute to and support the operations, |
2 | | programs
and capital development of public museums in this |
3 | | State.
For the purposes of this Section, "public museum" |
4 | | means a facility: (A) that
is operating for the purposes |
5 | | of promoting cultural development
through
special |
6 | | activities or programs or through performing arts that are
|
7 | | performed in an indoor setting, and acquiring,
conserving, |
8 | | preserving,
studying, interpreting, enhancing, and in |
9 | | particular, organizing and
continuously exhibiting |
10 | | specimens, artifacts, articles, documents and
other things |
11 | | of historical, anthropological, archaeological, |
12 | | industrial,
scientific or artistic import, to the public |
13 | | for its instruction and
enjoyment, and (B) that either (i) |
14 | | is operated by or located upon land
owned by a unit of |
15 | | local
government
or (ii) is a museum that has an annual |
16 | | attendance of at least
150,000 and
offers educational |
17 | | programs to school groups during school hours.
A museum is |
18 | | eligible to receive funds for capital development under
|
19 | | this subdivision (7)
only if it is operated by or located |
20 | | upon land owned by a unit of local
government or if it is |
21 | | certified by a unit of local
government in
which it is |
22 | | located as a public museum meeting the criteria of this |
23 | | Section.
Recipients of funds for capital development under
|
24 | | this subdivision (7) shall match State funds with local or |
25 | | private funding
according to the following:
|
26 | | (a) for a public museum with an attendance of |
|

|
1 | | 300,000 or less during the
preceding calendar year, no |
2 | | match is required;
|
3 | | (b) for a public museum with an attendance of over |
4 | | 300,000 but less than
600,000 during the preceding |
5 | | calendar year, the match must be at a ratio of $1
from |
6 | | local and
private funds for every $1 in State funds; |
7 | | and
|
8 | | (c) for a public museum with an attendance of over |
9 | | 600,000 during the
preceding calendar year, the match |
10 | | must be at a ratio of $2 from local and
private funds |
11 | | for every
$1 in State funds.
|
12 | | The Department shall formulate rules and regulations |
13 | | relating to the
allocation of any funds appropriated by |
14 | | the General Assembly for the
purpose of contributing to |
15 | | the support of public museums in this State.
|
16 | | (8) To perform all other duties and assume all |
17 | | obligations of the former
Department of Energy and Natural |
18 | | Resources and the former Department of
Registration and |
19 | | Education pertaining to the State Museum.
|
20 | | (9) To work in collaboration with the Division of |
21 | | Historic Preservation of the Department in the exercise of |
22 | | all the rights, powers, and duties conferred upon the |
23 | | Department under the Historic Preservation Act. |

1 | | Sec. 20-10. Board of the Illinois State Museum.
|
2 | | (a) Within the Department there shall be a Board of the |
3 | | Illinois State
Museum, composed of 11 persons, one of whom |
4 | | shall be a senior citizen age 60 or
over. The Board shall be |
5 | | composed of 9 representatives of the natural
sciences, |
6 | | anthropology, art, and business, qualified by at least 10 |
7 | | years of
experience in practicing or teaching their several |
8 | | professions; one senior
citizen; and the Director of Natural |
9 | | Resources or the Director's designee.
Members of the Board |
10 | | shall be appointed by the Governor with the advice and
consent |
11 | | of the Senate and shall serve for 2-year terms.
|
12 | | The transfer of the Board to the Department under this Act |
13 | | does not terminate
or otherwise affect the term of membership |
14 | | of any member of the Board, except
that the former Director of |
15 | | Energy and Natural Resources is replaced by the
Director of |
16 | | Natural Resources.
|
17 | | (b) The Board shall:
|
18 | | (1) advise the Director of the Department in all |
19 | | matters pertaining to
maintenance, extension and |
20 | | usefulness of the Illinois State Museum;
|
21 | | (2) make recommendations concerning the appointment of |
22 | | a new museum
director whenever a vacancy occurs in that |
23 | | position; and
|
24 | | (3) (blank);
|
25 | | (4) review the budget and approve budget requests of |
26 | | the Illinois State
Museum and make recommendations with |
|

5 | | Section 10. The Historic Preservation Act is amended by |
6 | | changing Sections 4.5, 5.1, 6, 11, 12, 13, 14, 15, and 16 and |
7 | | by adding Section 4.6 as follows: |

9 | | Sec. 4.5. Division of Historic Preservation. On and after |
10 | | August 3, 2018 (the effective date of Public Act 100-695), the |
11 | | Division of Historic Preservation of the Department of Natural |
12 | | Resources Office of Land Management shall be created exercise |

rights, powers, and duties
vested in the Historic Sites |
14 | | and
Preservation Division . The head of the Division shall be |
15 | | known as the Division Manager of Historic Preservation. The |
16 | | Department of Natural Resources may employ or retain other |
17 | | persons to assist in the discharge of its functions under this |
18 | | Act , subject to the Personnel Code and any other applicable |
19 | | Department policies.

18 | | Sec. 16. The Historic Sites and Preservation Division of |
19 | | the Department
shall have the following
additional powers:
|
20 | | (a) To hire agents and employees necessary to carry |
21 | | out the duties and
purposes of this Act the Historic Sites |
22 | | and Preservation Division of the Department .
|
23 | | (b) To take all measures necessary to erect, maintain, |
|

1 | | preserve, restore,
and conserve all State Historic Sites |
2 | | and State Memorials, except when
supervision and |
3 | | maintenance is otherwise provided by law. This
|
4 | | authorization includes the power to enter
into contracts, |
5 | | acquire and
dispose of real and personal property, and |
6 | | enter into leases of real and
personal property. The |
7 | | Department has the power to acquire, for purposes |
8 | | authorized by law, any real property in fee simple subject |
9 | | to a life estate in the seller in not more than 3 acres of |
10 | | the real property acquired, subject to the restrictions |
11 | | that the life estate shall be used for residential |
12 | | purposes only and that it shall be non-transferable.
|
13 | | (c) To provide recreational facilities, including |
14 | | campsites, lodges and
cabins, trails, picnic areas, and |
15 | | related recreational facilities, at all
sites under the |
16 | | jurisdiction of the Department.
|
17 | | (d) To lay out, construct, and maintain all needful |
18 | | roads, parking areas,
paths or trails, bridges, camp or |
19 | | lodge sites, picnic areas, lodges and
cabins, and any |
20 | | other structures and improvements necessary and |
21 | | appropriate
in any State historic site or easement |
22 | | thereto; and to provide water
supplies, heat and light, |
23 | | and sanitary facilities for the public and living
quarters |
24 | | for the custodians and keepers of State historic sites.
|
25 | | (e) To grant licenses and rights-of-way within the |
26 | | areas controlled
by the Historic Sites and Preservation |

|
1 | | Division of the Department for the
construction, |
2 | | operation,
and maintenance upon,
under or across the |
3 | | property, of facilities for water, sewage, telephone,
|
4 | | telegraph, electric, gas, or other public service, subject |
5 | | to the terms and
conditions as may be determined by the |
6 | | Department.
|
7 | | (f) To authorize the officers, employees, and agents |
8 | | of the Historic Sites
and Preservation
Division of the |
9 | | Department,
for the purposes of investigation and to |
10 | | exercise the rights,
powers, and duties vested and that |
11 | | may be vested in it, to enter and cross
all lands and |
12 | | waters in this State, doing no damage to private property.
|
13 | | (g) To transfer jurisdiction of or exchange any realty |
14 | | under the
control of the Historic Sites and Preservation |
15 | | Division of the Department to
any other Department of
the |
16 | | State Government,
or to any agency of the Federal |
17 | | Government, or to acquire or accept Federal
lands, when |
18 | | any transfer, exchange, acquisition, or acceptance is
|
19 | | advantageous to the State and is approved in writing by |
20 | | the Governor.
|
21 | | (h) To erect, supervise, and maintain all public |
22 | | monuments and memorials
erected by the State, except when |
23 | | the supervision and maintenance of
public monuments and |
24 | | memorials is otherwise provided by law.
|
25 | | (i) To accept, hold, maintain, and administer, as |
26 | | trustee, property given
in trust for educational or |
|

1 | | historic purposes for the benefit of the People
of the |
2 | | State of Illinois and to dispose of
any property under the |
3 | | terms of the
instrument creating the trust.
|
4 | | (j) To lease concessions on any property under the |
5 | | jurisdiction of the
Department for a period not exceeding |
6 | | 25 years and to lease a concession
complex at Lincoln's |
7 | | New Salem State Historic Site for which a cash
incentive |
8 | | has been authorized under Section 5.1 of this Act for a |
9 | | period not to exceed 40 years. All
leases, for whatever |
10 | | period, shall be made subject to the written approval
of |
11 | | the Governor. All concession leases extending for a period |
12 | | in excess of
10 years, will contain provisions for the |
13 | | Department to participate, on a
percentage basis, in the |
14 | | revenues generated by any concession operation.
|
15 | | The Department is authorized to allow for provisions |
16 | | for a reserve account and a leasehold account within |
17 | | Department concession lease agreements for the purpose of |
18 | | setting aside revenues for the maintenance, |
19 | | rehabilitation, repair, improvement, and replacement of |
20 | | the concession facility, structure, and equipment of the |
21 | | Department that are part of the leased premises. |
22 | | The lessee shall be required to pay into the reserve |
23 | | account a percentage of gross receipts, as set forth in |
24 | | the lease, to be set aside and expended in a manner |
25 | | acceptable to the Department by the concession lessee for |
26 | | the purpose of ensuring that an appropriate amount of the |
|

1 | | lessee's moneys are provided by the lessee to satisfy the |
2 | | lessee's incurred responsibilities for the operation of |
3 | | the concession facility under the terms and conditions of |
4 | | the concession lease. |
5 | | The lessee account shall allow for the amortization of |
6 | | certain authorized expenses that are incurred by the |
7 | | concession lessee but that are not an obligation of the |
8 | | lessee under the terms and conditions of the lease |
9 | | agreement. The Department may allow a reduction of up to |
10 | | 50% of the monthly rent due for the purpose of enabling the |
11 | | recoupment of the lessee's authorized expenditures during |
12 | | the term of the lease.

13 | | (k) To sell surplus agricultural products grown on |
14 | | land owned by or
under the jurisdiction of the Historic |
15 | | Sites and Preservation Division of
the Department, when |
16 | | the
products cannot be used
by the Department.
|
17 | | (l) To enforce the laws of the State and the rules and |
18 | | regulations of the Department
in or on any lands owned, |
19 | | leased, or managed by the Historic Sites and
Preservation
|
20 | | Division of the Department.
|
21 | | (m) To cooperate with private organizations and |
22 | | agencies of the
State of Illinois by providing areas and |
23 | | the use of staff personnel
where feasible for the sale of |
24 | | publications on the historic and cultural
heritage of the |
25 | | State and craft items made by Illinois craftsmen. These
|
26 | | sales shall not conflict with existing concession |

1 | | agreements. The
Historic Sites and Preservation Division |
2 | | of the Department is authorized to
negotiate with the
|
3 | | organizations and
agencies for a portion of the monies |
4 | | received from sales to be returned
to the Historic Sites |
5 | | and Preservation Division of the Department's Historic
|
6 | | Sites Fund
for the
furtherance of interpretive
and |
7 | | restoration programs.
|
8 | | (n) To establish local bank or savings and loan |
9 | | association
accounts, upon the written authorization of |
10 | | the Director, to temporarily
hold income received at any |
11 | | of its properties. The local accounts
established under |
12 | | this Section shall be in the name of the Department and |
13 | | shall be subject to regular audits. The balance in
a local |
14 | | bank or savings and loan association account shall be |
15 | | forwarded to
the Department for deposit with the State |
16 | | Treasurer on Monday of each week if
the amount to be |
17 | | deposited in a fund exceeds $500.
|
18 | | No bank or savings and loan association shall receive |
19 | | public funds as
permitted by this Section, unless it has |
20 | | complied with the requirements
established under Section 6 |
21 | | of the Public Funds Investment Act.
|
22 | | (o) To accept offers of gifts,
gratuities, or grants |
23 | | from the federal
government, its agencies, or offices, or |
24 | | from any person, firm, or
corporation.
|
25 | | (p) To make reasonable rules and regulations as may be |
26 | | necessary to
discharge the duties of the Department.

1 | | (q) With appropriate cultural organizations, to |
2 | | further and advance the
goals of the Department.
|
3 | | (r) To make grants for the purposes of planning, |
4 | | survey, rehabilitation,
restoration, reconstruction, |
5 | | landscaping, and acquisition of Illinois
properties (i) |
6 | | designated individually in the National
Register of |
7 | | Historic Places, (ii) designated as a landmark under a |
8 | | county or
municipal landmark ordinance, or (iii) located |
9 | | within a National Register of
Historic Places historic |
10 | | district or a locally designated historic district
when |
11 | | the Director determines that the property is of historic |
12 | | significance
whenever an
appropriation is made therefor by |
13 | | the General Assembly or whenever gifts or
grants are |
14 | | received for that purpose and to promulgate
regulations as |
15 | | may be necessary or desirable to carry out the purposes
of |
16 | | the grants.
|
17 | | Grantees may, as prescribed by rule, be required to |
18 | | provide matching funds
for each grant. Grants made under |
19 | | this subsection shall be known as Illinois
Heritage |
20 | | Grants.
|
21 | | Every owner of a historic property, or the owner's |
22 | | agent, is eligible to
apply for a grant under this |
23 | | subsection.
|
24 | | (s) To establish and implement a pilot program for |
25 | | charging admission to
State historic sites. Fees may be |
26 | | charged for special events, admissions, and
parking or any |

1 | | combination; fees may be charged at all sites or selected |
2 | | sites.
All fees shall be deposited into the Illinois |
3 | | Historic Sites Fund. The
Historic Sites and Preservation |
4 | | Division of the Department
shall have the discretion to |
5 | | set and adjust reasonable fees at the various
sites, |
6 | | taking into consideration various factors, including, but |
7 | | not limited to:
cost of services furnished to each |
8 | | visitor, impact of fees on attendance and
tourism, and the |
9 | | costs expended collecting the fees. The Department
shall |
10 | | keep
careful records of the income and expenses resulting |
11 | | from the imposition of
fees, shall keep records as to the |
12 | | attendance at each historic site, and shall
report to the |
13 | | Governor and General Assembly by January 31 after the |
14 | | close of
each year. The report shall include information |
15 | | on costs, expenses,
attendance, comments by visitors, and |
16 | | any other information the Department
may
believe |
17 | | pertinent, including:
|
18 | | (1) Recommendations as to whether fees should be |
19 | | continued at each State
historic site.
|
20 | | (2) How the fees should be structured and imposed.
|
21 | | (3) Estimates of revenues and expenses associated |
22 | | with each site.
|
23 | | (t) To provide for overnight tent and trailer |
24 | | campsites and to provide
suitable housing facilities for |
25 | | student and juvenile overnight camping
groups. The |
26 | | Historic Sites and Preservation Division of the Department |

1 | | shall
charge rates similar to those
charged by the |
2 | | Department
for the same or similar facilities and |
3 | | services.
|
4 | | (u) To engage in marketing activities designed to |
5 | | promote the sites and
programs administered by the |
6 | | Department. In
undertaking these activities, the |
7 | | Department
may take all necessary steps with respect
to |
8 | | products and services,
including, but not limited to, |
9 | | retail sales, wholesale sales, direct marketing,
mail |
10 | | order sales, telephone sales, advertising and promotion, |
11 | | purchase of
product and materials inventory, design, |
12 | | printing and manufacturing of new
products, reproductions, |
13 | | and adaptations, copyright and trademark licensing and
|
14 | | royalty agreements, and payment of applicable taxes. In |
15 | | addition, the Department
shall have the authority to sell |
16 | | advertising in its publications and printed
materials. All |
17 | | income from marketing
activities shall be deposited into |
18 | | the Illinois Historic Sites Fund.

1 | | (a) The Director shall include in the Department's
annual |
2 | | report an outline of State agency actions on which comment
was |
3 | | requested or issued under this Act.
|
4 | | (b) The Director shall maintain a current list of all |
5 | | historic resources
owned, operated, or leased by the State and |
6 | | appropriate maps indicating the
location of all such |
7 | | resources. These maps shall be in a form available to
the |
8 | | public and State agencies, except that the location of |
9 | | archaeological
resources shall be excluded.
|
10 | | (c) The Director shall make rules and issue appropriate |
11 | | guidelines to
implement this Act. These shall include, but not |
12 | | be limited to,
regulations for holding on-site inspections, |
13 | | public information meetings
and procedures for consultation, |
14 | | mediation, and resolutions by the
Committee pursuant to |
15 | | subsections (e) and (f) of Section 4.
|
16 | | (d) The Director shall (1) assist, to the fullest extent |
17 | | possible, the
State agencies in their identification of |
18 | | properties for inclusion in an
inventory of historic |
19 | | resources, including provision of criteria for
evaluation; (2) |
20 | | provide information concerning professional methods and
|
21 | | techniques for preserving, improving, restoring, and |
22 | | maintaining historic
resources when requested by State |
23 | | agencies; and (3) help facilitate State
agency compliance with |
24 | | this Act.
|
25 | | (e) The Director shall monitor the implementation of |
26 | | actions of each
State agency which have an effect, either |

|
1 | | adverse or beneficial, on an
historic resource.
|
2 | | (f) The Department of Natural Resources shall manage and |
3 | | control the preservation, conservation,
inventory,
and |
4 | | analysis of fine and decorative arts, furnishings, and |
5 | | artifacts of the
Illinois Executive
Mansion in Springfield, |
6 | | the Governor's offices in the Capitol in Springfield
and the |
7 | | James
R. Thompson Center in Chicago, and the Hayes House in |
8 | | DuQuoin.
The Department of Natural Resources shall manage the |
9 | | preservation and conservation of the
buildings and
grounds of |
10 | | the Illinois Executive Mansion in Springfield.
The Governor |
11 | | shall appoint a
Curator
of the Executive Mansion, with the |
12 | | advice and consent of the Senate, to assist
the Department of |
13 | | Natural Resources in
carrying
out the duties under this item |
14 | | (f).
The person
appointed Curator must have experience in |
15 | | historic preservation or as a
curator.
The Curator shall serve |
16 | | at the pleasure of the Governor.
The Governor shall determine |
17 | | the compensation of the Curator, which shall not
be diminished |
18 | | during the term of appointment.
