2 | | AMENDMENT NO. ______. Amend House Bill 4423 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The Illinois Public Aid Code is amended by |
5 | | changing Sections 4-1.6 as follows:
|
6 | | (305 ILCS 5/4-1.6) (from Ch. 23, par. 4-1.6)
|
7 | | Sec. 4-1.6. Need. Income available to the family as |
8 | | defined by the
Illinois Department by rule, or to the child
in |
9 | | the case of a child removed from his or her home, when added to
|
10 | | contributions in money, substance or services from other |
11 | | sources,
including income available from parents absent from |
12 | | the home or from a
stepparent, contributions made for the |
13 | | benefit of the parent or other
persons necessary to provide |
14 | | care and supervision to the child, and
contributions from |
15 | | legally responsible relatives, must be equal to or less than |
16 | | the grant amount established by Department regulation for such

1 | | a person. For purposes of eligibility for aid under this |
2 | | Article, the Department shall (a) disregard all earned income |
3 | | between the grant amount and 50% of the Federal Poverty Level |
4 | | and (b) disregard the value of all assets held by the family.
|
5 | | In considering income to be taken into account, |
6 | | consideration shall
be given to any expenses reasonably |
7 | | attributable to the earning of such
income. Three-fourths of |
8 | | the earned income of a household eligible for aid under this |
9 | | Article shall be disregarded when determining the level of |
10 | | assistance for which a household is eligible. All The first |
11 | | $100 of child support , whether it be current support, past |
12 | | support owed, or future support, that is collected on behalf |
13 | | of a family in a month for one child and the first $200 of |
14 | | child support collected on behalf of a family in a month for 2 |
15 | | or more children shall be passed through to the family and |
16 | | disregarded in determining the amount of the assistance grant |
17 | | provided to the family under this Article. Any amount of child |
18 | | support that would be disregarded in determining the amount of |
19 | | the assistance grant shall be disregarded in determining |
20 | | eligibility for cash assistance provided under this Article. |
21 | | The Illinois Department may also permit all or any
portion of |
22 | | earned or other income to be set aside for the future
|
23 | | identifiable needs of a child. The Illinois Department
may |
24 | | provide by rule and regulation for the exemptions thus |
25 | | permitted or
required. The eligibility of any applicant for or |
26 | | recipient of public
aid under this Article is not affected by |

1 | | the payment of any grant under
the "Senior Citizens and |
2 | | Persons with Disabilities Property Tax Relief Act" or any |
3 | | distributions or items of income
described under subparagraph |
4 | | (X) of
paragraph (2) of subsection (a) of Section 203 of the |
5 | | Illinois Income Tax
Act.

6 | | The Illinois Department may, by rule, set forth criteria |
7 | | under which an
assistance unit is ineligible for cash |
8 | | assistance under this Article for a
specified number of months |
9 | | due to the receipt of a lump sum payment.
