2 | AMENDMENT NO. ______. Amend House Bill 4414 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Expressway Camera Act is amended by | ||||||
5 | changing Sections 5 and 90 as follows: | ||||||
6 | (605 ILCS 140/5)
| ||||||
7 | (Section scheduled to be repealed on July 1, 2023) | ||||||
8 | Sec. 5. Camera program. | ||||||
9 | (a) The Illinois State Police, the Illinois Department of
| ||||||
10 | Transportation, and the Illinois State Toll Highway Authority
| ||||||
11 | shall work together to conduct a program to increase the | ||||||
12 | amount
of cameras along expressways and the State highway | ||||||
13 | system in the counties of Boone, Bureau, Champaign, Cook, | ||||||
14 | DeKalb, DuPage, Grundy, Henry, Kane, Kendall, Lake, LaSalle, | ||||||
15 | Macon, Madison, McHenry, Morgan, Peoria, Sangamon, St. Clair, | ||||||
16 | Will, and Winnebago Cook County . |

1 | (b) Images from the cameras may be used by any municipal | ||||||
2 | police department, county sheriff's office, State Police | ||||||
3 | officer, or other law enforcement agency with jurisdiction | ||||||
4 | over the expressway in Cook County in the investigation of any | ||||||
5 | offense involving the use of a firearm and to detect | ||||||
6 | expressway hazards. Images from the cameras shall not be used | ||||||
7 | to enforce petty offenses. | ||||||
8 | (c) Subject to appropriation, any funds needed to conduct | ||||||
9 | the program for use on expressways under the jurisdiction of | ||||||
10 | the Department of Transportation shall be taken from the Road | ||||||
11 | Fund. Any funds needed to conduct the program for use on | ||||||
12 | expressways under the jurisdiction of the Illinois State Toll | ||||||
13 | Highway Authority shall be paid for by funds from the Illinois | ||||||
14 | State Tollway Highway Authority. | ||||||
15 | (d) As used in this Section, "expressway" has the meaning | ||||||
16 | provided in Section 1-119.3 of the Illinois Vehicle Code.
