Amends the Illinois Pesticide Act. Provides that on and after January 1, 2023, no person or entity may use any product containing dicamba for agricultural, commercial, or residential use within the State. Provides that the amendatory provisions do not apply to the use of dicamba that is purchased before the amendatory Act's effective date. Defines "dicamba". Contains other provisions.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Pesticide Act is amended by adding |
5 | | Section 14.1 as follows: |
6 | | (415 ILCS 60/14.1 new) |
7 | | Sec. 14.1. Dicamba ban. |
8 | | (a) In this Section, "dicamba" means any product that is |
9 | | meant to inhibit the growth of weeds or other undesirable |
10 | | plants using the active ingredient |
11 | | 3,6-Dichloro-2-methoxybenzoic acid. |
12 | | (b) The purpose of this Section is to: |
13 | | (1) protect farmers and residential property owners |
14 | | from the economic consequences of the drift of volatile |
15 | | herbicides, both for those who receive herbicide drift and |
16 | | those who unwittingly allow herbicide to drift onto |
17 | | another person's property; and |
18 | | (2) to defend and protect Illinois' natural |
19 | | ecosystems. |
20 | | (c) On and after January 1, 2023, no person or entity may |
21 | | use any product containing dicamba for agricultural, |
22 | | commercial, or residential use within the State. |
23 | | (d) This Section does not apply to the use of dicamba that |
