SYNOPSIS AS INTRODUCED:
 
20 ILCS 505/5.26 new

    Amends the Children and Family Services Act. Provides that all youth in care shall be assigned a mental health provider to manage their mental health care needs. Requires a youth's mental health provider to visit the youth and conduct a well-being assessment within 30 days after the youth is removed from his or her home and placed in the temporary custody or guardianship of the Department of Children and Family Services. Provides that additional follow-up visits and well-being checks shall be scheduled and conducted until the youth is no longer under the custody or guardianship of the Department. Provides that any mental health care services provided to the youth shall be in addition to any care or services the youth receives from his or her primary care provider. Grants the Department rulemaking authority.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Children and Family Services Act is amended
5by adding Section 5.26 as follows:
 
6    (20 ILCS 505/5.26 new)
7    Sec. 5.26. Assigned mental health providers for youth in
8care. All youth in care shall be assigned a mental health
9provider to manage their mental health care needs. No later
10than 30 days after a youth in care is removed from his or her
11home and placed in the temporary custody or guardianship of
12the Department, the mental health provider assigned to the
13youth shall visit the youth and conduct a well-being
14assessment. Additional follow-up visits and well-being checks
15shall be scheduled and conducted until the youth is no longer
16under the custody or guardianship of the Department. Any
17mental health care and related services provided to the youth
18shall be in addition to any other care or services the youth
19receives from his or her primary care provider. The Department
20may adopt any rules necessary to implement the provisions of
21this Section, including rules to promote a holistic and
22proactive approach to the provision of mental health care for
23youth in care.
