SYNOPSIS AS INTRODUCED:
 
505 ILCS 30/5  from Ch. 56 1/2, par. 66.5

    Amends the Illinois Commercial Feed Act of 1961. Provides that commercial feed, pet food, and specialty pet food that contains peanuts, may contain peanuts, or is processed in a facility that processes peanuts, shall contain a prominent warning label stating that the product contains peanuts or may contain peanuts.

1    AN ACT concerning agriculture.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Commercial Feed Act of 1961 is
5amended by changing Section 5 as follows:
 
6    (505 ILCS 30/5)  (from Ch. 56 1/2, par. 66.5)
7    Sec. 5. Labeling.
8    (a) Any commercial feed, except customer-formula feed,
9distributed in this State shall be accompanied by a legible
10label bearing the following information:
11        (1) The net weight.
12        (2) The product and brand name, if any, under which
13    the commercial feed is distributed.
14        (3) The guaranteed analysis of the commercial feed
15    stated in terms as the Director determines by regulation,
16    that are necessary to advise the consumer of the
17    composition of the commercial feed or to support claims
18    made in the labeling. The substances or elements must be
19    determinable by laboratory methods as published by the
20    Association of Official Analytical Chemists or other
21    recognized methods as adopted in Section 9. When any items
22    are guaranteed, they shall be subject to inspection and
23    analysis by the Director.

1        (4) The common or usual names of each ingredient used
2    in the manufacture of the commercial feed, except as the
3    Director may, by regulation, permit the use of a
4    collective term for a group of ingredients which perform
5    similar functions.
6        (5) The name and principal address of the person
7    responsible for distributing the commercial feed.
8        (6) Directions for use for all commercial feeds
9    containing drugs and adequate directions for other
10    commercial feeds as the Director determines necessary for
11    their safe and effective use.
12        (7) Such precautionary statements as the Director
13    determines necessary for the safe and effective use of the
14    commercial feed.
15    (b) A customer-formula feed shall be accompanied by a
16label, invoice, delivery slip or other shipping document,
17bearing the following information:
18        (1) Name and address of the manufacturer.
19        (2) Name and address of the purchaser.
20        (3) Date of delivery or sale.
21        (4) The name of the product and brand name, if any, and
22    the net weight of each commercial feed and each other
23    ingredient used in the mixture.
24        (5) Directions for use and precautionary statements
25    for medicated and non-medicated feeds as necessary for
26    their safe and effective use.

1    (c) Any commercial feed, pet food, and specialty pet food
2that contains peanuts, may contain peanuts, or is processed in
3a facility that processes peanuts, shall contain a warning
4label. If the commercial feed, pet food, or specialty pet food
5contains peanuts, the warning label shall state "CONTAINS
6PEANUTS". If the commercial feed, pet food, or specialty pet
7food may contain peanuts or is processed in a facility that
8processes peanuts, the warning label shall state "MAY CONTAIN
9PEANUTS".
10        (1) The warning label shall be located in a prominent
11    place on the front of the item or package such that
12    consumers are likely to see the label when it is examined
13    under retail conditions.
14        (2) The label shall be conspicuous and not obscured by
15    other written matter.
16        (3) The label shall be legible.
17        (4) The label shall contrast with the typography,
18    layout, and color of the other printed matter.
