Amends the Environmental Protection Act. Prohibits the disposal by incineration of aqueous film-forming foam that contains perfluoroalkyl and polyfluoroalkyl substances in an area of environmental justice concern. Permits the Environmental Protection Agency to adopt rules it deems necessary to carry out the provisions. Effective immediately.

1 | | AN ACT concerning safety.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Environmental Protection Act is amended by |
5 | | adding Section 9.18 as follows: |
6 | | (415 ILCS 5/9.18 new) |
7 | | Sec. 9.18. Perfluoroalkyl and polyfluoroalkyl substances. |
8 | | (a) In this Section: |
9 | | "Incineration" includes, but is not limited to, burning, |
10 | | combustion, pyrolysis, gasification, thermal oxidation |
11 | | (including flameless and regenerative), acid recovery furnace |
12 | | or oxidizer, ore roaster, cement kiln, lightweight aggregate |
13 | | kiln, industrial furnace, boiler, and process heater. |
14 | | "Perfluoroalkyl and polyfluoroalkyl substances" means a |
15 | | class of fluorinated organic chemicals containing at least one |
16 | | fully fluorinated carbon atom. |
17 | | (b) The disposal by incineration of aqueous film-forming |
18 | | foam that contains perfluoroalkyl and polyfluoroalkyl |
19 | | substances is prohibited in an area of environmental justice |
20 | | concern. |
21 | | (c) The Agency may adopt rules it deems necessary to carry |
22 | | out the provisions of this Section.
