| 1 | | AN ACT concerning courts.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Circuit Court Clerk Regulation Act is |
| 5 | | amended by changing Section 1 as follows:
|
| 6 | | (705 ILCS 110/1) (from Ch. 37, par. 328)
|
| 7 | | Sec. 1.
It shall be unlawful for any clerk or deputy clerk |
| 8 | | of a circuit
court to prepare or draft any document which is to |
| 9 | | be filed or recorded in
the court in which he or she is clerk |
| 10 | | or deputy clerk, except such documents as
such clerks are by |
| 11 | | statute or supreme court order law required, or by some |
| 12 | | statute authorized to draft or
prepare; and that it shall be |
| 13 | | unlawful for any such clerk or deputy clerk
to act as an |
| 14 | | administrator, executor or guardian, or to act as
a trustee by |
| 15 | | appointment (of any court of which he or she is clerk or deputy
|
| 16 | | clerk) or of the last will of any person who is not a family |
| 17 | | member of
the clerk or deputy clerk.
|
| 18 | | For purposes of this Section, "family member" shall mean a |
| 19 | | spouse; child,
natural or adopted; parent; brother; or sister |
| 20 | | of the clerk or deputy clerk.
