1 | AN ACT concerning State government.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 1. Purpose. The purpose of this Act is to help | ||||||
5 | homeless service providers receive federal resources during | ||||||
6 | public health emergencies, including personal protective | ||||||
7 | equipment for which the Federal Emergency Management Agency | ||||||
8 | has final authority for reimbursement. | ||||||
9 | Section 5. The Department of Public Health Powers and | ||||||
10 | Duties Law of the
Civil Administrative Code of Illinois is | ||||||
11 | amended by adding Section 2310-434 as follows: | ||||||
12 | (20 ILCS 2310/2310-434 new) | ||||||
13 | Sec. 2310-434. Homeless service providers. | ||||||
14 | (a) In this Section, "homeless service provider" means a | ||||||
15 | person or entity who provides services to homeless persons | ||||||
16 | under any of the programs of or identified by the Department of | ||||||
17 | Human Services. | ||||||
18 | (b) The Department shall consider all homeless service | ||||||
19 | providers in the State to be essential critical infrastructure | ||||||
20 | workers in accordance with the most recent guidance from the | ||||||
21 | federal Cybersecurity and Infrastructure Security Agency. The | ||||||
22 | Department shall ensure that homeless service providers |

1 | qualify for the same priority benefits afforded to frontline | ||||||
2 | workers by the State, including, but not limited to: | ||||||
3 | (1) federal funding for relief relating to public | ||||||
4 | health emergencies; | ||||||
5 | (2) personal protective equipment; and | ||||||
6 | (3) vaccinations. | ||||||
7 | (c) In accordance with this Section, during a | ||||||
8 | federally-designated public health emergency or a public | ||||||
9 | health disaster declared by a proclamation issued by the | ||||||
10 | Governor under Section 7 of the Illinois Emergency Management | ||||||
11 | Agency Act, the Department and the Illinois Emergency | ||||||
12 | Management Agency shall offer recommendations to their local | ||||||
13 | counterparts, including local public health departments and | ||||||
14 | local emergency management assistance agencies, encouraging | ||||||
15 | them to consider homeless service providers when making | ||||||
16 | determinations about providing assistance. | ||||||
17 | (d) The Department may adopt rules for the implementation | ||||||
18 | and administration of this Section and to ensure that homeless | ||||||
19 | service providers are considered essential critical | ||||||
20 | infrastructure workers in the event of a pandemic.

21 | Section 99. Effective date. This Act takes effect upon | ||||||
22 | becoming law.
