SYNOPSIS AS INTRODUCED:

    Amends the State Police Act, the Counties Code, and the Illinois Municipal Code. Provides that an Illinois State Police officer, county sheriff, or municipal police officer may use a patrol vehicle to transport a sick or injured person if an ambulance or specialized emergency medical service vehicle is not available or on-scene, or a medical emergency exists. Exempts the Illinois State Police, county, or municipality and an Illinois State Police officer, county sheriff, or municipal police officer from liability for an act or omission in providing medical emergency transportation, unless the act or omission constitutes willful or wanton misconduct.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. This Act may be referred to as Courtney's Law.
 
5    Section 5. The State Police Act is amended by adding
6Section 50 as follows:
 
7    (20 ILCS 2610/50 new)
8    Sec. 50. Medical emergency transportation.
9    (a) An Illinois State Police officer may use a patrol
10vehicle to transport a sick or injured person if an ambulance
11or specialized emergency medical service vehicle is not
12available or on-scene, or a medical emergency exists.
13    (b) If an Illinois State Police officer transports a sick
14or injured person under this Section, neither the Illinois
15State Police nor an Illinois State Police officer shall be
16liable as a result of the Illinois State Police officer's act
17or omission in providing medical emergency transportation,
18including any assistance related thereto, unless the act or
19omission constitutes willful and wanton misconduct.
20    (c) As used in this Section:
21    "Ambulance" has the meaning defined in Section 3.85 of the
22Emergency Medical Services (EMS) Systems Act.

1    "Medical emergency" means a person is in need of immediate
2medical attention for a sickness or injury and delay in
3receiving that attention may endanger his or her life.
4    "Specialized emergency medical services vehicle" has the
5meaning defined in Section 3.85 of the Emergency Medical
6Services (EMS) Systems Act.
 
7    Section 10. The Counties Code is amended by adding Section
83-6041 as follows:
 
9    (55 ILCS 5/3-6041 new)
10    Sec. 3-6041. Medical emergency transportation.
11    (a) A sheriff may use a patrol vehicle to transport a sick
12or injured person if an ambulance or specialized emergency
13medical service vehicle is not available or on-scene, or a
14medical emergency exists.
15    (b) If a sheriff transports a sick or injured person under
16this Section, neither the county nor a sheriff shall be liable
17as a result of the sheriff's act or omission in providing
18medical emergency transportation, including any assistance
19related thereto, unless the act or omission constitutes
20willful and wanton misconduct.
21    (c) As used in this Section:
22    "Ambulance" has the meaning defined in Section 3.85 of the
23Emergency Medical Services (EMS) Systems Act.

9    Sec. 11-1-15. Medical emergency transportation.
10    (a) A municipal police officer may use a patrol vehicle to
11transport a sick or injured person if an ambulance or
12specialized emergency medical service vehicle is not available
13or on-scene, or a medical emergency exists.
14    (b) If a municipal police officer transports a sick or
15injured person under this Section, neither the municipality
16nor a municipal police officer shall be liable as a result of
17the municipal police officer's act or omission in providing
18medical emergency transportation, including any assistance
19related thereto, unless the act or omission constitutes
20willful and wanton misconduct.
21    (c) As used in this Section:
22    "Ambulance" has the meaning defined in Section 3.85 of the
23Emergency Medical Services (EMS) Systems Act.
