Amends the Juvenile Court Act of 1987. Provides that the Department of Children and Family Services is prohibited from making a determination in a case of abuse or neglect that would result in the termination of a parent's custody over his or her child, if the parent is a victim of domestic violence or reports being a victim of domestic violence. Provides that if a case of abuse or neglect is found, the Department's Office of the Inspector General must concur with the findings prior to terminating the parent's custodial rights. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Juvenile Court Act of 1987 is amended by |
5 | | adding Section 2-21.2 as follows: |
6 | | (705 ILCS 405/2-21.2 new) |
7 | | Sec. 2-21.2. Child custody. The Department of Children and |
8 | | Family Services is prohibited from making a determination in a |
9 | | case of abuse or neglect that would result in the termination |
10 | | of a parent's custody over his or her child, if the parent is a |
11 | | victim of domestic violence or reports being a victim of |
12 | | domestic violence. If a case of abuse or neglect is found, the |
13 | | Department's Office of the Inspector General must concur with |
14 | | the findings prior to terminating the parent's custodial |
15 | | rights.

16 | | Section 99. Effective date. This Act takes effect upon |
17 | | becoming law.
