1 | | AN ACT concerning transportation.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Vehicle Code is amended by |
5 | | changing Sections 11-804, 12-208, and 12-212 as follows:
|
6 | | (625 ILCS 5/11-804) (from Ch. 95 1/2, par. 11-804)
|
7 | | Sec. 11-804. When signal required.
|
8 | | (a) No person may turn a vehicle at an intersection unless |
9 | | the vehicle
is in proper position upon the highway roadway as |
10 | | required in Section 11-801 or
turn a vehicle to enter a private |
11 | | road or driveway, or otherwise turn a
vehicle from a direct |
12 | | course or move right or left upon a roadway unless
and until |
13 | | such movement can be made with reasonable safety. No person |
14 | | may
so turn any vehicle without giving an appropriate signal |
15 | | in the manner
hereinafter provided.

16 | | (b) A signal of intention to turn right or left , change |
17 | | lanes, otherwise turn a vehicle from a direct course, move |
18 | | right or left upon a highway, or when required must be
given |
19 | | continuously during not less than the last 100 feet traveled |
20 | | by the
vehicle before turning within a business or residence |
21 | | district, and such
signal must be given continuously during |
22 | | not less than the last 200 feet
traveled by the vehicle before |
23 | | turning outside a business or residence
district.

1 | | (c) No person may stop or suddenly decrease the speed of a |
2 | | vehicle
without first giving an appropriate signal in the |
3 | | manner provided in this
Chapter to the driver of any vehicle |
4 | | immediately to the rear when there is
opportunity to give such |
5 | | a signal.
|
6 | | (d) The electric turn signal device required in Section |
7 | | 12-208 of this
Act must be used and operated as prescribed in |
8 | | subsection (b) of this Section to indicate an intention to |
9 | | turn, change lanes , turn a vehicle from a direct course, move |
10 | | right or left upon a highway, or start
from a parallel parked |
11 | | position . Unless the conditions of subsection (b) of this |
12 | | Section are met, an electric turn signal device required in |
13 | | Section 12-208 shall not be left in the on position and but |
14 | | must not be flashed on one side only on
a parked or disabled |
15 | | vehicle or flashed as a courtesy or "do pass" signal
to |
16 | | operators of other vehicles approaching from the rear. |
17 | | However, such
signal devices may be flashed simultaneously on |
18 | | both sides of a motor
vehicle to indicate the presence of a |
19 | | vehicular traffic hazard requiring
unusual care in |
20 | | approaching, overtaking and passing.

23 | | Sec. 12-208. Signal lamps and signal devices.
|
24 | | (a) Every vehicle other than an antique vehicle displaying |
25 | | an antique
plate or an expanded-use antique vehicle displaying |

1 | | expanded-use antique vehicle plates operated in this State |
2 | | shall be equipped with a stop lamp or lamps on
the rear of the |
3 | | vehicle which shall display a red or amber light visible
from a |
4 | | distance of not less than 500 feet to the rear in normal |
5 | | sunlight
and which shall be actuated upon application of the |
6 | | service (foot) brake,
and which may but need not be |
7 | | incorporated with other rear lamps. During
times when lighted |
8 | | lamps are not required, an antique vehicle or an expanded-use |
9 | | antique vehicle may be
equipped with a stop lamp or lamps on |
10 | | the rear of such vehicle of the same
type originally installed |
11 | | by the manufacturer as original equipment and in
working |
12 | | order. However, at all other times, except as provided in |
13 | | subsection
(a-1), such antique vehicle or expanded-use antique |
14 | | vehicle must be
equipped with stop lamps meeting the |
15 | | requirements of Section 12-208 of this
Act.

16 | | (a-1) A motorcycle or an antique vehicle or an |
17 | | expanded-use antique vehicle, including an antique motorcycle, |
18 | | may display a blue light or lights of up to one
inch in |
19 | | diameter as part of the vehicle's rear stop lamp or lamps.
|
20 | | (b) Every motor vehicle other than an antique vehicle |
21 | | displaying an
antique plate or an expanded-use antique vehicle |
22 | | displaying expanded-use antique vehicle plates shall be |
23 | | equipped with an electric turn signal device which
shall |
24 | | indicate the intention of the driver to turn to the right or to |
25 | | the
left , change lanes, turn a vehicle, or otherwise turn or |
26 | | maneuver a vehicle from a direct course of travel in the form |

1 | | of flashing lights located at and showing to the front and
rear |
2 | | of the vehicle on the side of the vehicle toward which the turn |
3 | | is to
be made. The lamps showing to the front shall be mounted |
4 | | on the same level
and as widely spaced laterally as |
5 | | practicable and, when signaling, shall
emit a white or amber |
6 | | light, or any shade of light between white and amber.
The lamps |
7 | | showing to the rear shall be mounted on the same level and as
|
8 | | widely spaced laterally as practicable and, when signaling, |
9 | | shall emit a
red or amber light. An antique vehicle or |
10 | | expanded-use antique vehicle shall be equipped with a turn |
11 | | signal
device of the same type originally installed by the |
12 | | manufacturer as
original equipment and in working order.

13 | | (c) Every trailer and semitrailer shall be equipped with |
14 | | an electric
turn signal device which indicates the intention |
15 | | of the driver in the power
unit to turn to the right or to the |
16 | | left in the form of flashing red or
amber lights located at the |
17 | | rear of the vehicle on the side toward which
the turn is to be |
18 | | made and mounted on the same level and as widely spaced

19 | | laterally as practicable.
|
20 | | (d) Turn signal lamps must be visible from a distance of |
21 | | not less than
300 feet in normal sunlight.
|
22 | | (e) Motorcycles and motor-driven cycles need not be |
23 | | equipped with
electric turn signals. Antique vehicles and |
24 | | expanded-use antique vehicles need not be equipped with turn
|
25 | | signals unless such were installed by the manufacturer as |
26 | | original
equipment.

1 | | (f) (Blank).
|
2 | | (g) Motorcycles and motor-driven cycles may be equipped |
3 | | with a stop lamp or lamps on the rear of the vehicle that |
4 | | display a red or amber light, visible from a distance of not |
5 | | less than 500 feet to the rear in normal sunlight, that flashes |
6 | | and becomes steady only when the brake is actuated. |
7 | | (h) Electric turn signal lamps shall not be flashed or |
8 | | left in the on position other than to indicate the intention of |
9 | | a driver to turn a vehicle left or right, change lanes, or |
10 | | otherwise turn or maneuver a vehicle from a direct course of |
11 | | travel. |

14 | | Sec. 12-212. Special restrictions on lamps. |
15 | | (a) No person shall drive or
move any vehicle or equipment |
16 | | upon any highway with any lamp or device on
the vehicle or |
17 | | equipment displaying a red light visible from directly in
|
18 | | front of the vehicle or equipment except as otherwise provided |
19 | | in this Act.

20 | | (b) Subject to the restrictions of this Act, flashing |
21 | | lights are
prohibited on motor vehicles except as expressly |
22 | | authorized in this Chapter or as a means for indicating a right |
23 | | or
left turn , lane change, or a maneuver of a vehicle from a |
24 | | direct course of travel as provided in Section 12-208 or the |
25 | | presence of a vehicular
traffic hazard requiring unusual care |

1 | | as expressly provided in Sections 11-804 or 12-215.
|
2 | | (c) Unless otherwise expressly authorized by this Code, |
3 | | all other
lighting or combination of lighting on any vehicle |
4 | | shall be prohibited.
|
5 | | (d) No person shall drive or move any motor vehicle or |
6 | | equipment upon any highway with any lighting or combination of |
7 | | lighting with a smoked or tinted lens or cover. |

9 | | Section 99. Effective date. This Act takes effect upon |
10 | | becoming law.
