SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Public Employee Health Insurance During Emergencies Act. Provides that a public employee's health insurance coverage shall begin concurrent with employment if all of the following apply on the public employee's first date of employment with that public employer: the employment is in an area that is the subject of a gubernatorially or presidentially declared disaster or emergency; the declaration of disaster or emergency specifies that the disaster or emergency involves risks to the health or well-being of any individual who engages in certain activities; and among the activities posing a risk to an individual's health or well-being are activities integral to services to the public employer that the public employee is required to perform. Provides for payment of premiums.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Public
5Employee Health Insurance During Emergencies Act.
 
6    Section 5. Definitions. In this Act:
7    "Public employer" means the State, an agency or department
8thereof, unit of local government, school district,
9instrumentality, or political subdivision.
10    "Public employee" means an employee of the State, agency
11or department thereof, unit of local government, school
12district, instrumentality, or political subdivision. "Public
13employee" does not include an employee covered by the program
14of health benefits under the State Employees Group Insurance
15Act of 1971.
 
16    Section 10. Insurance coverage.
17    (a) Notwithstanding any other provision of law or any rule
18to the contrary, a public employee's health insurance coverage
19shall begin concurrent with employment if all of the following
20apply on the public employee's first date of employment with
21that public employer:
22        (1) The employment is in an area that is the subject of

1    a gubernatorially or presidentially declared disaster or
2    emergency.
3        (2) The declaration of disaster or emergency specifies
4    that the disaster or emergency involves risks to the
5    health or well-being of any individual who engages in
6    certain activities.
7        (3) Among the activities posing a risk to an
8    individual's health or well-being are activities integral
9    to services to the public employer that the public
10    employee is required to perform.
11    (b) The premium for the first month's insurance required
12under this Section shall be paid immediately. The public
13employer shall pay the employer contribution. The employee
14contribution may be paid by the public employer or the public
15employee. If the public employer pays the employee
16contribution, the public employer shall be reimbursed by a
17deduction from the public employee's wages.
