1 | AN ACT concerning domestic violence.
| ||||||
2 | WHEREAS, This Act is dedicated to the memory of Colton | ||||||
3 | Miller and the countless lives that have been lost as a result
| ||||||
4 | of domestic violence; therefore | ||||||
5 | Be it enacted by the People of the State of Illinois,
| ||||||
6 | represented in the General Assembly:
| ||||||
7 | Section 1. Short title. This Act may be cited as the | ||||||
8 | Domestic Violence Task Force Act. | ||||||
9 | Section 5. Public policy.
The purpose of this Act is to | ||||||
10 | establish a consistent, uniform statewide system to protect | ||||||
11 | victims and survivors of domestic violence, while holding | ||||||
12 | offenders accountable. | ||||||
13 | Section 10. Task Force; creation. The Domestic Violence | ||||||
14 | Task Force, also known as Colton's Task Force, is created. The | ||||||
15 | Task Force shall: | ||||||
16 | (1) conduct a comprehensive review of the process, | ||||||
17 | operation, and enforcement of current domestic violence laws | ||||||
18 | across the State; | ||||||
19 | (2) identify gaps in the process, operation, and | ||||||
20 | enforcement of those laws; | ||||||
21 | (3) develop recommendations to address those gaps; and |

1 | (4) establish a framework for specialized protective | ||||||
2 | networks for victims, treatment options for victims and | ||||||
3 | offenders, and specialty courts for the accumulation of | ||||||
4 | specialized domestic violence skills for courts. | ||||||
5 | Section 15. Task Force membership. | ||||||
6 | (a) The Domestic Violence Task Force shall be composed of | ||||||
7 | the following members: | ||||||
8 | (1) 2 judges appointed by the Illinois Supreme Court, | ||||||
9 | at least one of whom shall have experience with domestic | ||||||
10 | violence cases; | ||||||
11 | (2) the Director of the Administrative Office of the | ||||||
12 | Illinois Courts, or the Director's designee; | ||||||
13 | (3) one probation officer appointed by the Chief | ||||||
14 | Justice of the Illinois Supreme Court who has significant | ||||||
15 | experience with domestic violence cases; | ||||||
16 | (4) the Attorney General, or the Attorney General's | ||||||
17 | designee; | ||||||
18 | (5) the Director of the Illinois Criminal Justice | ||||||
19 | Information Authority, or the Director's designee; | ||||||
20 | (6) the following public members appointed by the | ||||||
21 | Governor: | ||||||
22 | (A) 2 members representing victims' rights | ||||||
23 | organizations; | ||||||
24 | (B) 2 members representing State's Attorneys based | ||||||
25 | on recommendations from the Illinois State's Attorneys |

1 | Association, both of which shall have experience with | ||||||
2 | domestic violence cases; | ||||||
3 | (C) 2 members representing law enforcement, both | ||||||
4 | of which shall have experience with domestic violence | ||||||
5 | cases; and | ||||||
6 | (D) one member representing family law lawyers who | ||||||
7 | shall have experience with domestic violence cases | ||||||
8 | based on a recommendation from a statewide bar | ||||||
9 | association; and | ||||||
10 | (7) the Director of the Illinois State Police, or the | ||||||
11 | Director's designee; | ||||||
12 | (8) the Secretary of Human Services, or the | ||||||
13 | Secretary's designee; | ||||||
14 | (9) one Representative appointed by the Speaker of the | ||||||
15 | House of Representatives; | ||||||
16 | (10) one Representative appointed by the Minority | ||||||
17 | Leader of the House of Representatives; | ||||||
18 | (11) one Senator appointed by the President of the | ||||||
19 | Senate; | ||||||
20 | (12) one Senator appointed by the Minority Leader of | ||||||
21 | the Senate; | ||||||
22 | (13) 4 members who are survivors of domestic violence, | ||||||
23 | one appointed
by the Speaker of the House of | ||||||
24 | Representatives, one appointed by the Minority Leader of | ||||||
25 | the House of
Representatives, one appointed by the | ||||||
26 | President of the
Senate, and one appointed by the Minority |

1 | Leader of the
Senate; and | ||||||
2 | (14) one member who is a survivor of domestic | ||||||
3 | violence, appointed by the
Governor.
| ||||||
4 | (b) The designated appointing authority listed in | ||||||
5 | subsection (a) shall have the authority to replace any of the | ||||||
6 | authority's appointed members.
| ||||||
7 | (c) The Chair of the Task Force shall be selected by a | ||||||
8 | majority vote of the members of the Task Force. | ||||||
9 | (d) Task Force members shall not be compensated for their | ||||||
10 | service on the Task Force. | ||||||
11 | Section 20. Administrative support and duties.
| ||||||
12 | (a) The Family Violence Coordinating Council within the | ||||||
13 | Illinois Criminal Justice Information Authority shall provide | ||||||
14 | administrative support to the Task Force. | ||||||
15 | (b) The Task Force shall review available research, best | ||||||
16 | practices, and effective interventions to formulate | ||||||
17 | recommendations. | ||||||
18 | (c) The Task Force shall produce a report detailing the | ||||||
19 | Task Force's findings and making recommendations. The Task | ||||||
20 | Force shall submit a report of its findings and | ||||||
21 | recommendations to the General Assembly and the Governor on or | ||||||
22 | before September 1, 2022.

23 | Section 25. Repeal. This Act is repealed on September 1, | ||||||
24 | 2027.

1 | Section 99. Effective date. This Act takes effect upon | ||||||
2 | becoming law.
