Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Provides that it shall be the duty of the Department of Commerce and Economic Opportunity to determine and designate disproportionately impacted areas for the purpose of the allocation of State services and for any other purpose which may be provided for under Illinois law. Provides the criteria by which the Department shall determine disproportionately impacted areas.

1 | | AN ACT concerning State government.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Department of Commerce and Economic |
5 | | Opportunity Law of the
Civil Administrative Code of Illinois |
6 | | is amended by adding Section 605-220 as follows: |
7 | | (20 ILCS 605/605-220 new) |
8 | | Sec. 605-220. Disproportionately impacted areas. |
9 | | (a) It shall be the duty of the Department to determine and |
10 | | designate disproportionately impacted areas for the purpose of |
11 | | the allocation of State services and for any other purpose |
12 | | which may be provided for under Illinois law. |
13 | | (b) The Department shall designate an area as a |
14 | | disproportionately impacted area when such area meets at least |
15 | | one of the following criteria: |
16 | | (1) the area has a poverty rate of at least 20% |
17 | | according to the latest federal decennial census; |
18 | | (2) 75% or more of the children in the area |
19 | | participate in the federal free lunch program according to |
20 | | reported statistics from the State Board of Education; |
21 | | (3) at least 20% of the households in the area receive |
22 | | assistance under the Supplemental Nutrition Assistance |
23 | | Program; or |
