Amends the School Code. If any payments from this State to a school district are delayed for at least one payment cycle, then allows the school board to discontinue, by publicly adopted resolution, any instructional mandate in the Courses of Study Article of the School Code during that time (with exceptions). Provides that if a student requests information on any instructional mandate that has been discontinued, then the school district shall provide the student with the requested information. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The School Code is amended by adding Section |
5 | | 27-2.5 as follows: |
6 | | (105 ILCS 5/27-2.5 new) |
7 | | Sec. 27-2.5. Instructional mandate discontinuance. |
8 | | (a) For the purposes of this Section, "instructional |
9 | | mandate" means any State law in this Article that requires a |
10 | | school district to devote any amount of time to the |
11 | | instruction of or engagement by students in a subject or |
12 | | course. |
13 | | (b) Notwithstanding Section 2-3.25g or any other provision |
14 | | of this Code, if any payments from this State to a school |
15 | | district are delayed for at least one payment cycle, then the |
16 | | school board may discontinue, by publicly adopted resolution, |
17 | | any instructional mandate in this Article. This Section, |
18 | | however, does not permit a school board to discontinue by |
19 | | resolution the requirements set forth in Sections 27-5, 27-6, |
20 | | 27-7, and 27-22 of this Code and Sections 27-24 through |
21 | | 27-24.8 of this Code. |
