Amends the Consumer Fraud and Deceptive Business Practices Act. Prohibits the advertising of nonwoven disposal products unless the product is flushable, septic safe, or sewer safe as provided by the Federal Trade Commission in Docket No. C-4556.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Consumer Fraud and Deceptive Business |
5 | | Practices Act is amended by adding Section 2WWW as follows: |
6 | | (815 ILCS 505/2WWW new) |
7 | | Sec. 2WWW. Nonwoven disposal products. |
8 | | (a) In this Section: |
9 | | (1) "Flushable, septic safe, or sewer safe" means a |
10 | | nonwoven disposable product that meets the tests for |
11 | | flushability established by the Federal Trade Commission |
12 | | in Docket No. C-4556 for non-misleading representations |
13 | | regarding the flushability of nonwoven disposable |
14 | | products. |
15 | | (2) "Nonwoven disposable product" means a product |
16 | | constructed from nonwoven sheets, including moist toilet |
17 | | tissue or cloth, that is designed, marketed, or commonly |
18 | | used for personal hygiene purposes. |
19 | | (b) No nonwoven disposable product for sale in this State |
20 | | may be advertised as flushable, septic safe, or sewer safe |
21 | | unless it meets the definition set forth in paragraph (1) of |
22 | | subsection (a) of this Section. |
23 | | (c) A violation of this Section constitutes an unlawful |
