1 | | AN ACT concerning State government.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Civil Administrative Code of Illinois is |
5 | | amended by adding Section 5-518 as follows: |
6 | | (20 ILCS 5/5-518 new) |
7 | | Sec. 5-518. Exception to professional state licensure for |
8 | | service members and spouses. |
9 | | (a) In this Section: |
10 | | "Service member" means any person who, at the time of |
11 | | notification under this Section, is an active duty member of |
12 | | the United States Armed Forces or any reserve component of the |
13 | | United States Armed Forces, the Coast Guard, or the National |
14 | | Guard of any state, commonwealth, or territory of the United |
15 | | States or the District of Columbia or whose active duty |
16 | | service concluded within the preceding 2 years. |
17 | | "Military spouse" means a resident or nonresident spouse, |
18 | | at the time of notification under this Section, of an active |
19 | | duty member of the United States Armed Forces or any reserve |
20 | | component of the United States Armed Forces, the Coast Guard, |
21 | | or the National Guard of any state, commonwealth, or territory |
22 | | of the United States or the District of Columbia or whose |
23 | | active duty service concluded within the preceding 2 years. |

1 | | (b) Except as otherwise provided by statute or rule, |
2 | | service member or military spouse may engage in the practice |
3 | | of his or her occupation or profession while the individual is |
4 | | stationed within this State, subject to the stated |
5 | | circumstances and limitations, without being licensed: |
6 | | (i) the service member or military spouse holds a |
7 | | valid license to practice a regulated occupation or |
8 | | profession issued by another state, commonwealth, |
9 | | territory of the United States, or the District of |
10 | | Columbia; |
11 | | (ii) the license is current and the service member or |
12 | | military spouse is in good standing in the state of |
13 | | licensure, the individual has not had a license or |
14 | | certificate revoked, the individual has not voluntarily |
15 | | surrendered a license or certificate in any other state or |
16 | | country while under investigation for unprofessional |
17 | | conduct, the individual has not had discipline imposed by |
18 | | any other regulating entity, and the individual does not |
19 | | have a complaint, allegation or investigation pending |
20 | | before another regulating entity in another state or |
21 | | country that relates to unprofessional conduct; |
22 | | (iii) when the service member or military spouse was |
23 | | licensed or certified by another state, commonwealth, |
24 | | territory of the United States, or the District of |
25 | | Columbia, there were minimum education requirements and, |
26 | | if applicable, work experience and clinical supervision |

1 | | requirements in effect and the other state, commonwealth, |
2 | | territory of the United States, or the District of |
3 | | Columbia verifies that the individual met those |
4 | | requirements in order to be licensed or certified; |
5 | | (iv) the service member or military spouse previously |
6 | | passed an examination required for the license or |
7 | | certification if required by the other state; |
8 | | (v) a complete set of the service member's or military |
9 | | spouse's fingerprints has been submitted to the Illinois |
10 | | State Police for statewide and national criminal history |
11 | | checks; the service member or military spouse shall pay |
12 | | the fee to the Illinois State Police or to the fingerprint |
13 | | vendor for electronic fingerprint processing; exception to |
14 | | licensure is not applicable if the statewide or national |
15 | | criminal history check discloses information that would |
16 | | cause the denial of licensure under any applicable |
17 | | occupational or professional licensing Act; and |
18 | | (vi) the service member or military spouse is not |
19 | | ineligible for licensure pursuant to Section 2105-165 of |
20 | | the Department of Professional Regulation Law of the Civil |
21 | | Administrative Code of Illinois. |
22 | | (c) A service member or military spouse who is exempted |
23 | | from licensure under subsection (a) shall comply with each |
24 | | requirement of the licensing jurisdiction from which the |
25 | | practitioner derives authority to practice. |
26 | | (d) A service member or military spouse who is authorized |

1 | | under this Section to practice or engage in an occupation or |
2 | | profession may engage in the lawful, professional, and |
3 | | competent practice of that occupation or profession without |
4 | | additional licensure under other State law, except as |
5 | | otherwise provided by this Section. |
6 | | (e) Violation of a limitation imposed by this Section |
7 | | constitutes grounds for removal of exempt status, denial of |
8 | | license, or other disciplinary proceedings. |
9 | | (f) Each director of a department that issues an |
10 | | occupational or professional license shall verify that the |
11 | | existing license of a service member or military spouse is in |
12 | | good standing from any state, commonwealth, or territory of |
13 | | the United States or the District of Columbia. |
14 | | (g) If an existing license of a service member or military |
15 | | spouse is in good standing, the Department of Financial and |
16 | | Professional Regulation shall waive any examination, |
17 | | educational, or experience requirements enabling exception to |
18 | | State licensure requirements. |
19 | | (h) A department may adopt any rules necessary for the |
20 | | implementation and administration of this Section and by rule |
21 | | shall provide for fees for the administration of this Section.
