Amends the Litter Control Act. Provides that a hauler who overfills his or her hauling vehicle such that waste or construction material falls off the top of the hauling vehicle while in transit is subject to a civil penalty of $250. Requires moneys from civil penalties received under the provisions to be paid to the Department of Agriculture, which shall deposit the moneys into the Agriculture in the Classroom Fund.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Litter Control Act is amended by adding |
5 | | Section 9.5 as follows: |
6 | | (415 ILCS 105/9.5 new) |
7 | | Sec. 9.5. Haulers; waste; civil penalty. |
8 | | (a) In this Section: |
9 | | "Department" means the Department of Agriculture. |
10 | | "Hauler" has the same meaning as provided under Section 5 |
11 | | of the Solid Waste Hauling and Recycling Program Act. "Hauler" |
12 | | includes a person who operates a semitrailer that hauls |
13 | | construction materials. |
14 | | "Semitrailer" has the same meaning as provided under |
15 | | Section 1.28 of the Motor Fuel Tax Law. |
16 | | (b) A hauler who overfills his or her hauling vehicle such |
17 | | that waste or construction material falls off the top the |
18 | | hauling vehicle while in transit is subject to a civil penalty |
19 | | of $250. |
20 | | (c) Moneys from civil penalties received under subsection |
21 | | (b) shall be paid to the Department, which shall deposit the |
22 | | moneys into the Agriculture in the Classroom Fund.
