Amends the Humane Care for Animals Act. Adds firefighter and paramedic to the list of persons who are authorized, after making a reasonable effort to locate the owner or person responsible for a companion animal, to enter a motor vehicle by any reasonable means if he or she has probable cause to believe that the animal's health or safety is at risk.

|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Humane Care for Animals Act is amended by |
| 5 | | changing Section 7.1 as follows:
|
| 6 | | (510 ILCS 70/7.1) (from Ch. 8, par. 707.1)

| 7 | | Sec. 7.1. Confinement in motor vehicle.
No owner or |
| 8 | | person shall confine any companion animal in a motor vehicle
|
| 9 | | in such a manner that places it in a life or health threatening
|
| 10 | | situation by exposure to a prolonged period of extreme heat or |
| 11 | | cold, without
proper ventilation or other protection from such |
| 12 | | heat or cold. In order to
protect the health and safety of a |
| 13 | | companion an animal, an animal control officer, firefighter, |
| 14 | | paramedic, law
enforcement officer, or Department investigator |
| 15 | | who has probable cause to
believe that this Section is being |
| 16 | | violated shall have authority to enter such
motor vehicle by |
| 17 | | any reasonable means under the circumstances after making a
|
| 18 | | reasonable effort to locate the owner or other person |
| 19 | | responsible.
|
| 20 | | A person convicted of violating this Section is guilty of |
| 21 | | a Class C
misdemeanor. A second or subsequent violation is a |
| 22 | | Class B misdemeanor.
