Amends the Illinois Income Tax Act. Creates an income tax checkoff for donations to the Pediatric and Rare Disease in Children Research Fund. Amends the State Finance Act to create the Pediatric and Rare Disease in Children Research Fund. Provides that moneys deposited into the Pediatric and Rare Disease in Children Research Fund shall be used by the Department of Public Health for the purpose of making grants to organizations in Illinois that conduct research, investigation, and experimentation that results in a better understanding of pediatric and rare diseases in children and an ultimate cure or treatment option. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 1. This Act may be referred to as Jonny's Law. |
5 | | Section 5. The State Finance Act is amended by adding |
6 | | Sections 5.935 and 6z-124 as follows: |

8 | | Sec. 5.935. The Pediatric and Rare Disease in Children |
9 | | Research Fund. |

11 | | Sec. 6z-124. The Pediatric and Rare Disease in Children |
12 | | Research Fund; creation. The Pediatric and Rare Disease in |
13 | | Children Research Fund is created as a special fund in the |
14 | | State treasury. Moneys deposited into the Fund shall be used |
15 | | by the Department of Public Health for the purpose of making |
16 | | grants to organizations in Illinois that conduct research, |
17 | | investigation, and experimentation that results in a better |
18 | | understanding of pediatric and rare diseases in children and |
19 | | an ultimate cure or treatment option. For the purposes of this |
20 | | Section, the term "research" includes, without limitation, |
21 | | expenditures to develop and advance the understanding, |

1 | | techniques, and modalities effective in early detection, |
2 | | prevention, cure, screening, and treatment of pediatric and |
3 | | rare diseases in children. The grant funds may not be used for |
4 | | institutional, organizational, or community-based overhead or |
5 | | other indirect costs. The Department may use moneys in the |
6 | | Pediatric and Rare Disease in Children Research Fund to |
7 | | provide additional funding to existing programs that are |
8 | | funded by the Childhood Cancer Research Fund. |
9 | | Section 10. The Illinois Income Tax Act is amended by |
10 | | adding Section 507JJJ as follows: |
11 | | (35 ILCS 5/507JJJ new) |
12 | | Sec. 507JJJ. The Pediatric and Rare Disease in Children |
13 | | Research Fund checkoff. For taxable years ending on or after |
14 | | December 31, 2021, the Department must print on its standard |
15 | | individual income tax form a provision (i) indicating that if |
16 | | the taxpayer wishes to contribute to the Pediatric and Rare |
17 | | Disease in Children Research Fund, he or she may do so by |
18 | | stating the amount of the contribution (not less than $1) on |
19 | | the return and (ii) stating that the contribution will reduce |
20 | | the taxpayer's refund or increase the amount of payment to |
21 | | accompany the return. Failure to remit any amount of increased |
22 | | payment shall reduce the contribution accordingly. This |
23 | | Section does not apply to any amended return.

24 | | Section 99. Effective date. This Act takes effect upon |
