1 | AN ACT concerning safety.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 1. Short title. This Act may be cited as the Fire | ||||||
5 | and Smoke Damper Inspection Act. | ||||||
6 | Section 5. Definitions. In this Act: | ||||||
7 | "Fire damper" means a device installed in ducts and air | ||||||
8 | transfer openings designed to close automatically upon | ||||||
9 | detection of heat and resist the passage of flame and | ||||||
10 | classified for use in either static systems that will | ||||||
11 | automatically shut down in the event of a fire or in dynamic | ||||||
12 | systems that continue to operate during a fire. A fire damper | ||||||
13 | is classified for use in dynamic systems if the fire damper is | ||||||
14 | tested and rated for closure under elevated temperature | ||||||
15 | airflow.

16 | "Smoke damper" means a device installed in ducts and air | ||||||
17 | transfer openings designed to resist the passage of smoke and | ||||||
18 | installed to operate automatically, controlled by a smoke | ||||||
19 | detection system, and, where required, capable of being | ||||||
20 | positioned from a fire command center.

21 | Section 10. Inspections; requirements. | ||||||
22 | (a) Inspections and testing of HVAC fire dampers and smoke |

1 | dampers shall be conducted by individuals certified by the | ||||||
2 | International Certification Board and Accredited to comply | ||||||
3 | with ISO/IEC 17024 (the conformity assessment regarding | ||||||
4 | general requirements for bodies operating certification of | ||||||
5 | persons) by: (1) the American National Standards Institute | ||||||
6 | (ANSI) in HVAC fire life safety; or (2) another nationally | ||||||
7 | recognized certifying body accredited to ISO/IEC 17024 in HVAC | ||||||
8 | fire life safety. | ||||||
9 | (b) Fire damper and smoke damper inspections and testing | ||||||
10 | shall comply with each of the following: | ||||||
11 | (1) Inspections shall be conducted by inspectors | ||||||
12 | certified by the International Certification Board and | ||||||
13 | accredited by: | ||||||
14 | (A) the American National Standards Institute; or | ||||||
15 | (B) another nationally recognized certifying body | ||||||
16 | to ISO/IEC 17024 in HVAC fire life safety. | ||||||
17 | (2) Inspectors under this Section shall certify that | ||||||
18 | all fire and smoke dampers inspected meet the standards | ||||||
19 | established in the applicable code or codes adopted by any | ||||||
20 | authority having jurisdiction. | ||||||
21 | (c) The provisions of this Act do not apply to facilities | ||||||
22 | licensed by the federal Nuclear Regulatory Commission under | ||||||
23 | the provisions of 10 CFR 50 or 10 CFR 52 or to employees of | ||||||
24 | those facilities while engaged in the performance of their | ||||||
25 | official duties.
