1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section
55-12001.3 as follows:
 
6    (55 ILCS 5/5-12001.3 new)
7    Sec. 5-12001.3. Waiver of building, inspection, and
8construction fees.
9    (a) As used in this Section, "disaster" includes, but is
10not limited to, an occurrence or threat of widespread or
11severe damage, injury, or loss of life or property resulting
12from any natural or technological cause, including, but not
13limited to, fire, flood, earthquake, wind, storm, hazardous
14materials spill, or other water contamination, epidemic, air
15contamination, blight, extended periods of severe and
16inclement weather, drought, infestation, critical shortages of
17essential fuels and energy, explosion, riot, hostile military
18or paramilitary action, public health emergencies, or acts of
19domestic terrorism.
20    (b) Notwithstanding any other provision of law, a county
21board or board of county commissioners may, by resolution,
22waive any fees or costs associated with a permit, inspection,
23or certification of occupancy required by law for

1construction, reconstruction, alteration, repair, movement to
2another site, removal, or demolition of a manufactured home,
3building, dwelling, or structure, either commercial or
4residential, damaged as a result of a disaster, emergency,
5weather event, or for any reason deemed warranted in the
6interests of public safety, welfare, and recovery of the
7community by the county board or board of county
8commissioners.
 
9    Section 10. The Township Code is amended by adding Section
10110-12 as follows:
 
11    (60 ILCS 1/110-12 new)
12    Sec. 110-12. Waiver of building, inspection, and
13construction fees.
14    (a) As used in this Section, "disaster" includes, but is
15not limited to, an occurrence or threat of widespread or
16severe damage, injury, or loss of life or property resulting
17from any natural or technological cause, including, but not
18limited to, fire, flood, earthquake, wind, storm, hazardous
19materials spill, or other water contamination, epidemic, air
20contamination, blight, extended periods of severe and
21inclement weather, drought, infestation, critical shortages of
22essential fuels and energy, explosion, riot, hostile military
23or paramilitary action, public health emergencies, or acts of

1    (b) Notwithstanding any other provision of law, a board of
2trustees of a township may, by resolution, waive any fees or
3costs associated with a permit, inspection, or certification
4of occupancy required by law for construction, reconstruction,
5alteration, repair, movement to another site, removal, or
6demolition of a manufactured home, building, dwelling, or
7structure, either commercial or residential, damaged as a
8result of a disaster, emergency, weather event, or for any
9reason deemed warranted in the interests of public safety,
10welfare, and recovery of the community by the board of
11trustees of the township.
 
12    Section 15. The Illinois Municipal Code is amended by
13adding Section 11-13-1.2 as follows:
 
14    (65 ILCS 5/11-13-1.2 new)
15    Sec. 11-13-1.2. Waiver of building, inspection, and
16construction fees.
17    (a) As used in this Section, "disaster" includes, but is
18not limited to, an occurrence or threat of widespread or
19severe damage, injury, or loss of life or property resulting
20from any natural or technological cause, including, but not
21limited to, fire, flood, earthquake, wind, storm, hazardous
22materials spill, or other water contamination, epidemic, air
23contamination, blight, extended periods of severe, and

5council of a municipality may, by resolution, waive any fees
6or costs associated with a permit, inspection, or
7certification of occupancy required by law for construction,
8reconstruction, alteration, repair, movement to another site,
9removal, or demolition of a manufactured home, building,
10dwelling, or structure, either commercial or residential,
11damaged as a result of a disaster, emergency, weather event,
12or for any reason deemed warranted in the interests of public
13safety, welfare, and recovery of the community by the city
14council of the municipality.
 
15    Section 99. Effective date. This Act takes effect upon
16becoming law.
