Amends the Environmental Protection Act. Provides that, notwithstanding any other provision of law, pretreated seeds shall not be used in the production of ethanol. Defines "pretreated seeds".

| 2 | | Be it enacted by the People of the State of Illinois,

| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Environmental Protection Act is amended by |
| 5 | | adding Section 22.62 as follows:
|
| 6 | | (415 ILCS 5/22.62 new) |
| 7 | | Sec. 22.62. Pretreated seed ban; ethanol production. |
| 8 | | (a) Notwithstanding any other provision of law, pretreated |
| 9 | | seeds shall not be used in the production of ethanol. |
| 10 | | (b) In this Section, "pretreated seeds" means any |
| 11 | | manufactured seed that is treated before planting with |
| 12 | | pesticides, as that term is defined in Section 4 of the |
| 13 | | Illinois Pesticide Act.
