Amends the Nursing Home Care Act. Requires facilities licensed under the Act to annually publish a record of all Type "AA", Type "A", and Type "B" violations of the facility received from the Department of Public Health for a period of no less than 5 years prior to the year each record is published. Provides that the record must be published prominently on the facility's website. Provides disciplinary action for violation of the requirements. Effective January 1, 2022.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Nursing Home Care Act is amended by adding |
5 | | Section 2-218 as follows: |
6 | | (210 ILCS 45/2-218 new) |
7 | | Sec. 2-218. Publishing records of violations. |
8 | | (a) A facility shall annually publish a record of all Type |
9 | | "AA", Type "A", and Type "B" violations of the facility |
10 | | received from the Department for a period of no less than 5 |
11 | | years prior to the year each record is published. The record |
12 | | must be
published prominently on the facility's website either |
13 | | on: |
14 | | (1) the homepage; or |
15 | | (2) a secondary page accessed from a prominent menu |
16 | | option entitled "IDPH violations" at the top of the |
17 | | website's homepage. |
18 | | (b) A violation of this Section shall result in the |
19 | | following disciplinary action: |
20 | | (1) For a first violation, a civil penalty of up to |
21 | | $10,000. |
22 | | (2) For a second violation, a civil penalty of up to |
23 | | $25,000. |
