AMENDMENT TO HOUSE BILL 1725

2    AMENDMENT NO. ______. Amend House Bill 1725 as follows:
 
3on page 1, line 4, after "by", by inserting "changing Sections
45-2 and 5-4 and by"; and
 
5on page 1, immediately below line 5, by inserting the
6following:
 
7    "(105 ILCS 5/5-2)  (from Ch. 122, par. 5-2)
8    Sec. 5-2. Governing board.
9    (a) Except as otherwise provided in subsection (b), the
10The school business of all school townships having school
11trustees shall be transacted by three trustees, to be elected
12by the qualified voters of the township, as hereinafter
13provided in subsection (c).
14    (b) The school business of Lyons Township shall be
15transacted, as provided in subsection (c), by 4 trustees, to

1be elected by the qualified voters of the township, and 3
2trustees who shall be appointed by the school boards of the
3school districts that comprise the majority of land within
4Lyons Township, as follows:
5        (1) one trustee who is appointed by the school boards
6    of Argo Community High School District 217, Summit School
7    District 104, Willow Springs School District 108, and
8    Indian Springs School District 109;
9        (2) one trustee who is appointed by the school boards
10    of Lyons School District 103, La Grange School District
11    102, and La Grange School District 105 South; and
12        (3) one trustee who is appointed by the school boards
13    of Pleasantdale School District 107, LaGrange Highlands
14    School District 106, and Western Springs School District
15    101.
16    (c) The trustees shall be a body politic and corporate, by
17the name of "trustees of schools of township No. ...., range
18No. ....," according to the number, or in case of school
19townships created from two or more congressional townships,
20such name shall be "trustees of .... township .... county,
21Illinois." Such corporation shall have perpetual existence,
22with power to sue and be sued, and to plead and be impleaded,
23in all courts and places where judicial proceedings are had.

1    Sec. 5-4. Election of trustees. The election of trustees
2of schools shall be held in odd-numbered years at the election
3specified in the general election law. In townships in which
4no election for school trustees has been held, or in townships
5in which from any cause there are no trustees of schools and
6the law requires that there be school trustees, the election
7of trustees of schools shall be held at the same time.
8    No person shall be nominated for the office of trustee of
9schools, in townships containing 20,000 inhabitants or over,
10except by petition signed by at least 5% of the total amount of
11twenty-five voters of the school township in which the person
12he is seeking nomination and election who last cast votes in
13the most recent election, filed with the township treasurer,
14or, in case of a first election, with the county clerk.
15    A candidate for election as a school trustee, who has
16petitioned for nomination to fill a full term and to fill a
17vacant term to be voted upon at the same election, must
18withdraw his or her petition for nomination from either the
19full term or the vacant term by written declaration, which
20shall be signed and acknowledged by an officer authorized to
21take such acknowledgments and which is filed with the township
22treasurer in the township in which he or she is a candidate
23within the time provided by the general election law.
