2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Vehicle Code is amended by |
5 | | changing Section 11-500 as follows: |
6 | | (625 ILCS 5/11-500) (from Ch. 95 1/2, par. 11-500)

7 | | Sec. 11-500. Definitions. For the
the purposes of |
8 | | interpreting Sections
6-206.1 and 6-208.1 of this Code, "first |
9 | | offender" shall mean any person
who has not had a previous |
10 | | conviction or court assigned supervision for
violating Section |
11 | | 11-501, or a similar provision of a local ordinance,
or a |
12 | | conviction in any other state for a violation of driving while |
13 | | under
the influence or a similar offense where the cause of |
14 | | action is the same
or substantially similar to this Code or |
15 | | similar offenses committed on a military installation, or any |
16 | | person who has not had a driver's license suspension pursuant |
17 | | to paragraph 6 of subsection (a) of Section 6-206 as the result |
18 | | of refusal of chemical testing in another state, or any
person |
19 | | who has not had a driver's license
suspension or revocation |
20 | | for violating Section 11-501.1 within 5 years prior to the |
21 | | date of
the
current offense, except in cases where the driver |
22 | | submitted to
chemical testing resulting in an alcohol |
23 | | concentration of 0.08 or
more,
or any amount of a drug, |
