    Amends the Federal Prisoner Production Expense Act. Makes a technical change in a Section concerning expenses.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Federal Prisoner Production Expense Act is
5amended by changing Section 1 as follows:
 
6    (725 ILCS 155/1)  (from Ch. 38, par. 156-11)
7    Sec. 1. Whenever a federal prisoner in the the custody of
8the Attorney General of the United States or his authorized
9representative has been produced in a court of this State for
10prosecution of a criminal charge pending against such federal
11prisoner in such court, the costs and expenses of producing
12and returning such prisoner shall be paid out of the state
13treasury, on the certificate of the Governor and warrant of
14the State Comptroller, if the prosecution of such charge
15results in a sentence of imprisonment exceeding one year; and
16in all other cases such costs and expenses shall be paid out of
17the county treasury in the county wherein the offense charged
18was allegedly committed. Such costs and expenses shall include
19the cost of necessary travel in producing and returning such
20prisoner. The necessary travel expenses allowed shall be the
21same, as near as may be, as the amounts for travel allowed
22pursuant to the rules and regulations of the Illinois
23Department of Central Management Services. Before such

1accounts shall be certified by the Governor, or paid by the
2county, they shall be verified by affidavit, and certified to
3by the state's attorney of the county wherein the offense
4charged was allegedly committed, and submitted therewith shall
5be documentary evidence of the authority for such travel by
6the prisoner and his custodians.
