AMENDMENT TO HOUSE BILL 378

2    AMENDMENT NO. ______. Amend House Bill 378 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Revenue Sharing Act is amended by
5changing Section 3 as follows:
 
6    (30 ILCS 115/3)  (from Ch. 85, par. 613)
7    Sec. 3. Use of Fund.
8    (a) The amounts allocated and paid to the municipalities
9and counties of this State pursuant to the provisions of this
10Act shall be used solely for the general welfare of the people
11of the State of Illinois, including financial assistance to
12school districts, any part of which lie within the
13municipality or county, through unrestricted block grants for
14school purposes carried out within the municipality or county
15making the grant, and also including, but not limited to,
16mental health programs, wastewater projects, road and bridge

1construction and repair and social service programs.
2    (b) Beginning on the effective date of this amendatory Act
3of the 102nd General Assembly, the amounts allocated and paid
4to municipalities and counties under this Act may also be used
5for the procurement of black-owned media services as provided
6under subsection (b) of Section 35-45 of the Illinois
7Procurement Code.

9    Section 10. The Illinois Procurement Code is amended by
10adding Section 35-45 as follows:
 
11    (30 ILCS 500/35-45 new)
12    Sec. 35-45. Purchase of black-owned media services.
13    (a) Beginning on the effective date of this amendatory Act
14of the 102nd General Assembly, it shall be the aspirational
15goal of the State that for any State agency subject to the
16provisions of this Code, no less than 10% of the total dollar
17amount used by that State agency for the purchase of media
18services shall be used to procure the services of black-owned
19media.
20    (b) As soon as practicable after the effective date of
21this amendatory Act of the 102nd General Assembly, each unit
22of local government, including school districts and community
23college districts, shall adopt an ordinance or resolution that
24establishes an aspirational goal that no less than 10% of the

1total dollar amount used for the purchase of media services
2shall be used to procure the services of black-owned media.
3Municipalities and counties may use moneys allocated and
4disbursed under Section 2 of the State Revenue Sharing Act for
5the purposes of this subsection (b).
6    (c) If any State agency or public institution of higher
7education contract is eligible to be paid for or reimbursed,
8in whole or in part, with federal-aid funds, grants, or loans,
9and the provisions of this Section would result in the loss of
10those federal-aid funds, grants, or loans, then the contract
11is exempt from the provisions of this Section in order to
12remain eligible for those federal-aid funds, grants, or loans.
13    (d) Each State agency under the jurisdiction of this Code
14shall file with the Commission on Equity and Inclusion an
15annual compliance plan which shall outline the State agency's
16efforts and progress towards the goal of using media services
17funds to procure services of black-owned media for the then
18immediately preceding fiscal year.
19    (e) For the purposes of this Section, "black-owned media"
20means a newspaper or other periodical issued at regular
21intervals whether in print or electronic format, a news
22service whether in print or electronic format, a radio
23station, a television station, a television network, a
24community antenna television service, or any other person,
25business, or corporation that is (i) majority owned by black
26or African American persons, (ii) certified by the Business

1Enterprise Program as a minority-owned business or women-owned
2business, and (iii) engaged in making any written, oral, or
3electronic communication that contains news, promotion, or
4inducement.".
