SYNOPSIS AS INTRODUCED:
 
110 ILCS 205/9.40 new

    Amends the Board of Higher Education Act. Provides that each public institution of higher education shall study and issue a report on the cost-saving methods and practices utilized by the public institution for improving students' timely access to required course materials and the affordability of required course materials. Sets forth the required areas of study that must be included in the report. Provides that the report from each public institution must be submitted to the Board of Higher Education or Illinois Community College Board no later than August 1, 2022. Provides that no later than February 1, 2023, the Board of Higher Education and the Illinois Community College Board shall submit a joint report to the Governor and General Assembly that summarizes the findings from the reports submitted by public institutions. Requires the Board of Higher Education and the Illinois Community College Board to post each institution's report and the joint report on their respective websites. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Board of Higher Education Act is amended by
5adding Section 9.40 as follows:
 
6    (110 ILCS 205/9.40 new)
7    Sec. 9.40. College course materials access and
8affordability study.
9    (a) To examine the cost-saving methods and practices
10utilized by each public institution of higher education for
11improving students' timely access to required course materials
12and the affordability of required course materials, each
13public institution, after consultation with administrators,
14faculty, campus bookstores, and publishers, shall conduct a
15course materials access and affordability study and shall
16submit a report of the study's findings to the Board of Higher
17Education if the public institution is a university and to the
18Illinois Community College Board if the public institution is
19a community college.
20    (b) The report shall include all of the following areas:
21        (1) A list of cost-saving methods available to
22    students, including, but not limited to, inclusive access
23    programs developed by publishers, textbook subscription

1    programs, textbook rental programs, used textbooks, and
2    other institutional textbook cost-saving methods, such as
3    open educational resources.
4        (2) The total amount of cost savings achieved by the
5    public institution and the total number of students that
6    utilized each cost-saving method.
7        (3) A description of the process required to implement
8    each cost-saving method listed in paragraph (1) of this
9    subsection.
10        (4) A description of the process by which students
11    obtain required course materials.
12        (5) The identification of best practices resulting
13    from the cost-saving methods listed in paragraph (1) of
14    this subsection.
15        (6) An examination of the following areas:
16            (A) whether the methods improved access to
17        required course materials by the first day of class;
18            (B) whether the methods increased the
19        affordability of required course materials; and
20            (C) whether the methods improved access to
21        learning materials and improved student outcomes for
22        minority, low-income, and first generation students.
23        (7) A description of the ways students and faculty are
24    utilizing or have utilized inclusive access programs,
25    subscription programs, textbook rental programs, used
26    textbooks, and open educational resources for the purposes

1    of remote learning as a result of the COVID-19 pandemic
2    health crisis.
3    (c) Each public university shall submit its report to the
4Board of Higher Education and each public community college
5shall submit its report to the Illinois Community College
6Board no later than August 1, 2022.
7    (d) The Board of Higher Education and the Illinois
8Community College Board shall review each submitted report to
9ensure that each report addresses all of the areas listed in
10subsection (b). The Board of Higher Education and the Illinois
11Community College Board shall post the reports on their
12respective websites no later than October 1, 2022.
13    (e) No later than February 1, 2023, the Board of Higher
14Education and the Illinois Community College Board shall
15submit a joint report to the Governor and General Assembly
16that summarizes the findings from the reports submitted by
17public institutions of higher education, including the areas
18listed in subsection (b).
19    (f) No later than February 1, 2023, the Board of Higher
20Education and the Illinois Community College Board shall post
21the joint report on their respective websites.
 
22    Section 99. Effective date. This Act takes effect upon
23becoming law.
