4 | | Sec. 10. Definitions. As used in this Act:
|
5 | | "Agency" means the Environmental Protection Agency.

6 | | "Alternate fuel" means electricity, excluding on-board |

12 | | "Alternate fuel vehicle" means any vehicle that is

13 | | operated in Illinois and is capable of using an alternate |
14 | | fuel.

15 | | "Biodiesel fuel" means a renewable fuel conforming to the |
16 | | industry standard
ASTM-D6751 and registered with the U.S. |
17 | | Environmental Protection Agency.

18 | | "Car sharing organization" means an organization whose |
19 | | primary business is a membership-based service that allows |
20 | | members to drive cars by the hour in order to extend the public |
21 | | transit system, reduce personal car ownership, save consumers |
22 | | money, increase the use of alternative transportation, and |
23 | | improve environmental sustainability. |
24 | | "Conventional", when used to modify the word "vehicle",
|
25 | | "engine", or "fuel", means gasoline or diesel or any
|

1 | | reformulations of those fuels.
|
2 | | "Covered Area" means the counties of Cook, DuPage, Kane, |
3 | | Lake, McHenry, and
Will and those portions of Grundy County |
4 | | and Kendall County that are included
in the following ZIP code |
5 | | areas, as designated by the U.S. Postal Service on
the |
6 | | effective date of this amendatory Act of 1998: 60416, 60444, |
7 | | 60447, 60450,
60481, 60538, and 60543.
|
8 | | "Director" means the Director of the Environmental |
9 | | Protection Agency.
|
10 | | "Domestic renewable fuel" means a fuel, produced in the
|
11 | | United States, composed of a minimum 80% ethanol, 80% |
12 | | bio-based
methanol, or 20% biodiesel fuel.
|
13 | | "E85 blend fuel" means fuel that contains 85% ethanol and |
14 | | 15% gasoline.
|
15 | | "Electric vehicle" means a vehicle that is licensed to |
16 | | drive on public roadways, is predominantly powered by, and |
17 | | primarily refueled with, electricity, and does not have |
18 | | restrictions confining it to operate on only certain types of |
19 | | streets or roads. |
20 | | "Environmental justice community" has the same meaning, |
21 | | based on existing methodologies and findings, used and as may |
22 | | be updated by the Illinois Power Agency and its Program |
23 | | Administrator of the Illinois Solar for All Program. |
24 | | "GVWR" means Gross Vehicle Weight Rating.

25 | | "Location" means (i) a parcel of real property or (ii)
|
26 | | multiple, contiguous parcels of real property that are |

by private roadways, public roadways, or private or |
2 | | public
rights-of-way and are owned, operated, leased, or under |
3 | | common
control of one party.

4 | | "Low income" means persons and families whose income does |
5 | | not exceed 80% of area median income, adjusted for family size |
6 | | and revised every 2 years.
|
7 | | "Original equipment manufacturer" or "OEM" means a
|
8 | | manufacturer of alternate fuel vehicles or a manufacturer or
|
9 | | remanufacturer of alternate fuel engines used in vehicles |
10 | | greater
than 8500 pounds GVWR.
|
11 | | "Rental vehicle" means any motor vehicle that is owned
or |
12 | | controlled primarily for the purpose of short-term leasing or
|
13 | | rental pursuant to a contract.

16 | | Sec. 15. Rulemaking. The Agency shall promulgate rules
and |
17 | | dedicate sufficient resources to implement the purposes of
|
18 | | Section 30 of this Act. Such rules shall be
consistent with the |
19 | | provisions of the Clean Air Act Amendments of 1990 and any
|
20 | | regulations promulgated pursuant thereto. The Secretary of |
21 | | State may
promulgate rules to implement Section 27 Section 35 |
22 | | of this Act. The Department of
Commerce and Economic |
23 | | Opportunity may promulgate rules to implement Section 25 of
|
24 | | this Act.

2 | | Sec. 27. Environmental justice communities; low income |
3 | | rebate. |
4 | | (a) Beginning January 1, 2022, and continuing as long as |
5 | | funds are available, the Agency shall administer $4,000 |
6 | | rebates to environmental justice community low income |
7 | | residents. |
8 | | (b) Beginning January 1, 2026, the Agency shall administer |
9 | | $2,000 rebates to environmental justice community low income |
10 | | residents. |
11 | | (c) Beginning January 1, 2028, the Agency shall administer |
12 | | $1,000 rebates to environmental justice community low income |
13 | | residents. |
14 | | (d) Rebates administered under this Section shall only be |
15 | | available for new passenger battery electric vehicles at a |
16 | | prerebate cost of $45,000 or less or for used battery electric |
17 | | vehicles at a prerebate cost of $35,000 or less. This cost cut |
18 | | off is exclusive of any electric vehicle-specific rebate |
19 | | offered by any level of government. If the cost of the electric |
20 | | vehicle would be higher than the cost cut off without any |
21 | | electric vehicle-specific rebate, the vehicle is not eligible |
22 | | for a rebate under this Section. |
23 | | (e) A rebate administered under this Section may be |
24 | | combined with other rebates for eligible vehicles and drivers. |
25 | | The rebate may only be applied one time per Vehicle |

1 | | Identification Number. The rebate may only be used once per |
2 | | person in any 5-year period. To be eligible for the low income |
3 | | rebate, a purchaser must be a resident of Illinois and provide |
4 | | proof of residence at the time of purchase. The State shall |
5 | | direct rebate recipients to local electric utilities where |
6 | | additional charging equipment rebates may be available. |
