|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Children's Mental Health Act of 2003 is |
5 | | amended by changing Section 5 as follows:
|
6 | | (405 ILCS 49/5)
|
7 | | Sec. 5. Children's Mental Health Plan.
|
8 | | (a) The State of Illinois shall develop a Children's |
9 | | Mental Health Plan
containing short-term and long-term |
10 | | recommendations to provide
comprehensive, coordinated mental
|
11 | | health prevention, early intervention, and treatment services |
12 | | for children from
birth through age 18. This Plan
shall |
13 | | include but not be limited to:
|
14 | | (1) Coordinated provider services and interagency |
15 | | referral networks for
children from birth through age 18 |
16 | | to maximize resources and
minimize duplication of |
17 | | services.
|
18 | | (2) Guidelines for incorporating social and emotional |
19 | | development into
school learning standards and educational |
20 | | programs, pursuant to
Section 15 of this Act.

21 | | (3) Protocols for implementing screening and |
22 | | assessment of children prior
to any admission to an |
23 | | inpatient hospital for psychiatric services,
pursuant to |
|

1 | | subsection (a) of Section 5-5.23 of the Illinois Public |
2 | | Aid
Code.
|
3 | | (4) Recommendations regarding a State budget for |
4 | | children's mental
health prevention, early intervention, |
5 | | and treatment across all State
agencies.
|
6 | | (5) Recommendations for State and local mechanisms for |
7 | | integrating
federal, State, and local
funding sources for |
8 | | children's mental health.
|
9 | | (6) Recommendations for building a qualified and |
10 | | adequately trained
workforce prepared to provide mental |
11 | | health services for children
from birth through age 18 and |
12 | | their families.
|
13 | | (7) Recommendations for facilitating research on best |
14 | | practices and
model programs, and dissemination of this |
15 | | information to Illinois
policymakers, practitioners, and |
16 | | the general public through training,
technical assistance, |
17 | | and educational materials.
|
18 | | (8) Recommendations for a comprehensive, multi-faceted |
19 | | public
awareness campaign to reduce the stigma of mental |
20 | | illness and
educate families, the general public, and |
21 | | other key audiences about the
benefits of children's |
22 | | social and emotional development, and how to
access |
23 | | services.
|
24 | | (9) Recommendations for creating a quality-driven |
25 | | children's mental
health system with shared accountability |
26 | | among key State agencies
and programs that conducts |

1 | | ongoing needs assessments, uses outcome
indicators and |
2 | | benchmarks to measure progress, and implements
quality |
3 | | data tracking and reporting systems. |
4 | | (10) Recommendations for ensuring all Illinois youth |
5 | | receive mental health education and have access to mental |
6 | | health care in the school setting. In developing these |
7 | | recommendations, the Children's Mental Health Partnership |
8 | | created under subsection (b) shall consult with the State |
9 | | Board of Education, education practitioners, including, |
10 | | but not limited to, administrators, regional |
11 | | superintendents of schools,
teachers, and school support |
12 | | personnel, health care
professionals, including mental |
13 | | health professionals and child health leaders, disability |
14 | | advocates, and other representatives as necessary to |
15 | | ensure the interests of all students are represented.

16 | | (b) The Children's Mental Health Partnership (hereafter |
17 | | referred to as "the
Partnership") is created. The Partnership |
18 | | shall have the responsibility of
developing and monitoring the |
19 | | implementation of the Children's Mental
Health Plan as |
20 | | approved by the Governor. The Children's Mental Health
|
21 | | Partnership shall be comprised of: the Secretary of Human |
22 | | Services or his or
her designee; the State Superintendent of |
23 | | Education or his or her
designee; the directors of the |
24 | | departments of Children and Family
Services, Healthcare and |
25 | | Family Services, Public Health, and Juvenile Justice, or their
|
26 | | designees;
the head of the Illinois Violence Prevention |

1 | | Authority, or his or her
designee; the Attorney General or his |
2 | | or her designee; up to 25
representatives of community mental |
3 | | health authorities and statewide mental
health, children and |
4 | | family advocacy,
early childhood, education, health, substance |
5 | | abuse, violence prevention,
and juvenile justice organizations |
6 | | or associations, to be appointed by the
Governor; and 2 |
7 | | members of each caucus of the House of
Representatives and |
8 | | Senate appointed by the Speaker of the House of
|
9 | | Representatives and the President of the Senate, respectively. |
10 | | The
Governor shall appoint the Partnership Chair and shall |
11 | | designate a
Governor's staff liaison to work with the |
12 | | Partnership.
|
13 | | (c) The Partnership shall submit a Preliminary Plan to the |
14 | | Governor on
September 30, 2004 and shall submit the Final Plan |
15 | | on June 30, 2005.
Thereafter, on September 30 of each year, the |
16 | | Partnership shall submit an
annual report to the Governor on |
17 | | the progress of Plan implementation
and recommendations for |
18 | | revisions in the Plan.
The Final Plan and annual reports |
19 | | submitted in subsequent years shall include
estimates of |
20 | | savings achieved in prior fiscal years under subsection (a) of
|
21 | | Section
5-5.23 of the Illinois Public Aid Code and federal |
22 | | financial participation
received under subsection (b) of
|
23 | | Section 5-5.23 of that Code. The Department of Healthcare and |
24 | | Family Services shall provide
technical assistance in |
25 | | developing these estimates and reports.
