Creates the Local Government Business Anti-Poaching Act. Provides that no municipality or county shall offer any incentive after the effective date of the Act to a business or corporation to move its headquarters located in Illinois, or any part of its business located in Illinois, away from the current location at the time of the offering of the incentive. Defines "incentive". Limits home rule powers. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 1. Short title. This Act may be cited as the Local |
5 | | Government Business Anti-Poaching Act. |
6 | | Section 5. Definition. As used in this Act, "incentive" |
7 | | means any economic, financial benefit, or other incentive, |
8 | | including, but not limited to, those authorized under the |
9 | | Economic Development for a Growing Economy Tax Credit Act, the |
10 | | Property Tax Code, the Counties Code, the Illinois Municipal |
11 | | Code (including, but not limited to, the Tax Increment |
12 | | Allocation Redevelopment Act), or any other provision of law |
13 | | authorizing abatements, credits, or tax or fee reductions. |
14 | | Section 10. Illinois business poaching prohibited. |
15 | | Notwithstanding any other provision of law, no municipality or |
16 | | county shall offer any incentive after the effective date of |
17 | | this Act to a business or corporation to move its headquarters |
18 | | located in Illinois, or any part of its business located in |
19 | | Illinois, away from the current location at the time of the |
20 | | offering of the incentive.

21 | | Section 15. Home rule. The regulation of offering |
