2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||
3 | represented in the General Assembly:
| ||||||||||||||||||||||||||
4 | Section 5. The General Assembly Compensation Act is | ||||||||||||||||||||||||||
5 | amended by changing Section 1 as follows: | ||||||||||||||||||||||||||
6 | (25 ILCS 115/1) (from Ch. 63, par. 14) | ||||||||||||||||||||||||||
7 | Sec. 1. Each member of the General Assembly shall receive | ||||||||||||||||||||||||||
8 | an annual salary
of $28,000 or as set by the Compensation | ||||||||||||||||||||||||||
9 | Review Board, whichever is
greater. The
following named | ||||||||||||||||||||||||||
10 | officers, committee chairmen and committee minority spokesmen

11 | shall receive additional amounts per year for

15 | who serves in more than one
position as an officer, committee | ||||||
16 | chairman, or committee minority spokesman
shall receive only | ||||||
17 | one additional amount based on the position paying the
highest | ||||||
18 | additional amount. The
compensation provided for in this | ||||||
19 | Section to be paid per year to members
of the General Assembly, | ||||||
20 | including the additional sums payable per year
to officers of | ||||||
21 | the General Assembly shall be paid in 12 equal monthly
| ||||||
22 | installments. The first such installment is payable on January | ||||||
23 | 31,
1977. All subsequent equal monthly installments are | ||||||
24 | payable on the last
working day of the month. A member who has | ||||||
25 | held office any part of a
month is entitled to compensation for | ||||||
26 | an entire month. |

1 | Mileage shall be paid at the rate of 20 cents per mile | ||||||
2 | before January
9, 1985, and at the mileage allowance rate in | ||||||
3 | effect under regulations
promulgated pursuant to 5 U.S.C. | ||||||
4 | 5707(b)(2) beginning January 9, 1985, for the number
of actual | ||||||
5 | highway miles necessarily and conveniently traveled by the
| ||||||
6 | most feasible route to be present upon convening of the | ||||||
7 | sessions of the
General Assembly by such member in each and | ||||||
8 | every trip during each
session in going to and returning from | ||||||
9 | the seat of government, to be
computed by the Comptroller. A | ||||||
10 | member traveling by public
transportation for such purposes, | ||||||
11 | however, shall be paid his actual cost
of that transportation | ||||||
12 | instead of on the mileage rate if his cost of
public | ||||||
13 | transportation exceeds the amount to which he would be | ||||||
14 | entitled
on a mileage basis. No member may be paid, whether on | ||||||
15 | a mileage basis
or for actual costs of public transportation, | ||||||
16 | for more than one such
trip for each week the General Assembly | ||||||
17 | is actually in session. Each
member shall also receive an | ||||||
18 | allowance of $36 per day for lodging and
meals while in | ||||||
19 | attendance at sessions
of the General Assembly before January | ||||||
20 | 9, 1985; beginning January 9,
1985, such food and lodging | ||||||
21 | allowance shall be equal to the amount per day
permitted to be | ||||||
22 | deducted for such expenses under the Internal Revenue Code;
| ||||||
23 | however, beginning May 31, 1995, no allowance for food and | ||||||
24 | lodging while in
attendance at sessions is authorized for | ||||||
25 | periods of time after the last day in
May of each calendar | ||||||
26 | year, except (i) if the General Assembly is convened in

1 | special session by either the Governor or the presiding | ||||||
2 | officers of both
houses, as provided by subsection (b) of | ||||||
3 | Section 5 of Article IV of the
Illinois Constitution or (ii) if | ||||||
4 | the
General Assembly is convened to consider bills vetoed, | ||||||
5 | item vetoed, reduced, or
returned with specific | ||||||
6 | recommendations for change by the Governor as provided
in | ||||||
7 | Section 9 of Article IV of the Illinois Constitution. For | ||||||
8 | fiscal year 2011 and for session days in fiscal years 2012, | ||||||
9 | 2013, 2014, 2015, 2016, 2017, 2018, and 2019 only (i) the | ||||||
10 | allowance for lodging and meals is $111 per day and (ii) | ||||||
11 | mileage for automobile travel shall be reimbursed at a rate of | ||||||
12 | $0.39 per mile. | ||||||
13 | Notwithstanding any other provision of law to the | ||||||
14 | contrary, beginning in fiscal year 2012, travel reimbursement | ||||||
15 | for
General Assembly members on non-session days shall be
| ||||||
16 | calculated using the guidelines set forth by the Legislative
| ||||||
17 | Travel Control Board, except that fiscal year 2012, 2013, | ||||||
18 | 2014, 2015, 2016, 2017, 2018, and 2019 mileage reimbursement | ||||||
19 | is set at a rate of $0.39 per mile. | ||||||
20 | A member may, prior to being sworn into office, elect to | ||||||
21 | reject any travel reimbursement provided under this Section. | ||||||
22 | Once a member elects to reject travel reimbursement, he or she | ||||||
23 | shall not be eligible to receive travel reimbursement under | ||||||
24 | this Section for the remainder of his or her elected term of | ||||||
25 | office or for any subsequent term of office for which he or she | ||||||
26 | may be elected to the same house of the General Assembly. Any |

1 | moneys received by a member for purposes of travel | ||||||
2 | reimbursement may voluntarily be repaid by a member to the | ||||||
3 | State in a manner prescribed by the Comptroller. | ||||||
4 | If a member dies having received only a portion of the | ||||||
5 | amount payable
as compensation, the unpaid balance shall be | ||||||
6 | paid to the surviving
spouse of such member, or, if there be | ||||||
7 | none, to the estate of such member. | ||||||

10 | Section 10. The Compensation Review Act is amended by | ||||||
11 | adding Section 7 as follows: | ||||||
12 | (25 ILCS 120/7 new) | ||||||
13 | Sec. 7. COLA opt-out. Notwithstanding any provision of law | ||||||
14 | to the contrary, members of the General Assembly and executive | ||||||
15 | branch constitutional officers of State government may, prior | ||||||
16 | to being sworn into office, elect not to receive any increase | ||||||
17 | in compensation that would otherwise apply based on a cost of | ||||||
18 | living adjustment as authorized by Senate Joint Resolution 192 | ||||||
19 | of the 86th General Assembly. Once a member of the General | ||||||
20 | Assembly or an executive branch constitutional officer elects | ||||||
21 | not to receive a cost of living adjustment, he or she shall not | ||||||
22 | be eligible to receive a cost of living adjustment for the | ||||||
23 | remainder of his or her elected term of office or for any | ||||||
24 | subsequent term of office for which he or she may be elected to |

1 | the same office. Any increase in compensation received as a | ||||||
2 | cost of living adjustment by a member of the General Assembly | ||||||
3 | or an executive branch constitutional officer may voluntarily | ||||||
4 | be repaid by a member or an officer to the State in a manner | ||||||
5 | prescribed by the Comptroller.
