1 | SENATE RESOLUTION
| ||||||
2 | WHEREAS, The State has 12 properties on its surplus real | ||||||
3 | property list and multiple other vacant properties; and
| ||||||
4 | WHEREAS, These properties contain over 200 unused | ||||||
5 | buildings that are dispersed across the State, from Rockford to | ||||||
6 | Tamms; and
| ||||||
7 | WHEREAS, The State is responsible for maintaining these | ||||||
8 | properties and is using vital State resources on vacant | ||||||
9 | buildings, sometimes expending more on maintenance than the | ||||||
10 | fair-market value of the properties; and
| ||||||
11 | WHEREAS, The State has struggled to sell these properties, | ||||||
12 | retaining responsibility for these surplus properties for many | ||||||
13 | years; and
| ||||||
14 | WHEREAS, The failure to sell these properties has resulted | ||||||
15 | in further degradation and loss of market value; after years of | ||||||
16 | neglect and underfunded property maintenance, some of these | ||||||
17 | properties require environmental remediation or demolition; | ||||||
18 | and
| ||||||
19 | WHEREAS, The current condition of the properties could | ||||||
20 | expose the State to liability claims; and

1 | WHEREAS, The current process for disposing of vacant and | ||||||
2 | surplus State property is cumbersome, requires interagency | ||||||
3 | cooperation, and fails to either quickly dispose of the | ||||||
4 | properties or maximize their value; and
| ||||||
5 | WHEREAS, No single State agency owns all these vacant | ||||||
6 | properties; and
| ||||||
7 | WHEREAS, The Department of Central Management Services is | ||||||
8 | the lead agency in managing State properties and possesses the | ||||||
9 | experience, legal knowledge, and best practices to address this | ||||||
10 | issue; therefore, be it
| ||||||
11 | RESOLVED, BY THE SENATE OF THE ONE HUNDRED FIRST GENERAL | ||||||
12 | ASSEMBLY OF THE STATE OF ILLINOIS, that each property-owning | ||||||
13 | agency or office shall provide, in a timely manner, the | ||||||
14 | Department of Central Management Services with its laws, | ||||||
15 | practices, and administrative rules pertaining to the sale or | ||||||
16 | disposal of real property and any transferable property located | ||||||
17 | on the premises of the real property; and be it further
| ||||||
18 | RESOLVED, That the Department of Central Management | ||||||
19 | Services shall compile and summarize these requirements and | ||||||
20 | submit recommendations to the Governor and the General Assembly | ||||||
21 | on any changes to statutes, administrative rules, or existing |

1 | practices that would improve or facilitate the sale process; | ||||||
2 | and be it further
| ||||||
3 | RESOLVED, That these findings be included in a report and | ||||||
4 | submitted to the Governor and the General Assembly no later | ||||||
5 | than September 1, 2021.
