SYNOPSIS AS INTRODUCED:
 

 
65 ILCS 5/3.1-55-30 new

     Amends the Illinois Municipal Code. Provides that expenses used from an expense account of a municipal officer or an individual who reports directly to the municipal officer shall be submitted to and retained by the municipality. Provides that the documentation is subject to any audit performed on municipal finances and is subject to disclosure under the Freedom of Information Act in the same manner as documentation of other expenses of the municipality. Limits home rule powers.

1    AN ACT concerning local government.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  
 
 
4    Section 5. The Illinois Municipal Code is amended  by adding 
5Section  3.1-55-30 as follows:
 
6    (65 ILCS 5/3.1-55-30  new)
7    Sec. 3.1-55-30. Expense accounts of municipal officers. 
8Notwithstanding any other provision of law, all documentation 
9relating to expenses used from an expense account of a 
10municipal officer or an individual who reports directly to the 
11municipal officer shall be submitted to and retained by the 
12municipality. The documentation is subject to any audit 
13performed on municipal finances and is subject to disclosure 
14under the Freedom of Information Act in the same manner as 
15documentation of other expenses of the municipality.
16    A home rule municipality may not regulate expense accounts 
17in a manner inconsistent with this Section. This Section is a 
18limitation under subsection (i) of Section 6 of Article VII of 
19the Illinois Constitution on the concurrent exercise by home 
20rule units of powers and functions exercised by the State.
