Amends the Removal of Private Compromising Images Act. Provides that a person posts a private compromising image when he or she disseminates a private compromising image that was taken with the consent of the person depicted in the image, but the person in the image did not consent to the dissemination of the image.

1 | | AN ACT concerning civil law.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Removal of Private Compromising Images Act |
5 | | is amended by changing Section 10 as follows: |
6 | | (735 ILCS 115/10)
|
7 | | Sec. 10. Posting of private compromising images. A person |
8 | | shall not post a private compromising image of another person |
9 | | online. A person posts a private compromising image when he or |
10 | | she: |
11 | | (1) intentionally disseminates an image of another |
12 | | person: |
13 | | (A) who is at least 18 years of age; |
14 | | (B) who is identifiable from the image itself or |
15 | | information displayed in connection with the image; |
16 | | and |
17 | | (C) whose intimate parts are exposed, in whole or |
18 | | in part; |
19 | | (2) obtains the image under circumstances in which a |
20 | | reasonable person would know or understand that the image |
21 | | was taken without the person's knowledge or consent; and |
22 | | (3) knows or should have known that the person in the |
23 | | image has not consented to the dissemination; or |
