Amends the Flood Control Act of 1945. Provides that the Department of Natural Resources shall waive its rules requiring the submission of a U.S. Army Corps of Engineers study for levee modification permits for levee and drainage districts located in counties under the disaster proclamation signed by the Governor related to disastrous flooding from May 3, 2019 to July 26, 2019. Provides that in the absence of a written objection from the U.S. Army Corps of Engineers or the submission of a study by the Department showing adverse impact, all permit requests that comply with all statutory requirements shall be approved. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Flood Control Act of 1945 is amended by |
5 | | adding Section 2.5 as follows: |
6 | | (615 ILCS 15/2.5 new) |
7 | | Sec. 2.5. Waiver of rules. |
8 | | (a) The Department of Natural Resources shall waive its |
9 | | rules requiring the submission of a U.S. Army Corps of |
10 | | Engineers study for levee modification permits under 17 Ill. |
11 | | Admin. Code 3700 for levee and drainage districts located in |
12 | | counties under the disaster proclamation signed by the Governor |
13 | | related to disastrous flooding from May 3, 2019 to July 26, |
14 | | 2019. |
15 | | (b) In the absence of a written objection from the U.S. |
16 | | Army Corps of Engineers or the submission of a study by the |
17 | | Department of Natural Resources showing adverse impact, all |
18 | | permit requests that comply with all statutory requirements not |
19 | | inconsistent with this amendatory Act of the 101st General |
20 | | Assembly shall be approved.

21 | | Section 99. Effective date. This Act takes effect upon |
22 | | becoming law.
